CRM-M-35448-2026 (O&M) -1- IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH 168 CRM-M-35448-2026 (O&M) Date of decision:06.07.2026 Mandeep Singh @ Pappi Singh & others ... Petitioners Vs. State of Punjab ... Respondent CORAM: HON'BLE MRS. JUSTICE MANISHA BATRA. Present: Mr. Gurbhej Singh Aulakh, Advocate for the petitioners. ... MANISHA BATRA, J. (ORAL). 1. Petitioners are seeking quashing of order dated 01.04.2026 as passed by the Court of learned Additional Chief Judicial Magistrate, Mansa in case arising out of FIR No.17, dated 17.01.2025, registered under Sections 118(1), 115(2), 117(2) and 3(5) of the BNS, at Police Station Sadar Mansa, District Mansa, whereby bail of the petitioners had been cancelled and their bail bonds/surety bonds were forfeited to the State and warrants of arrest were ordered to be issued against them for 08.07.2026. 2. It is argued by learned counsel for the petitioners that the petitioners had been regularly appearing before the learned trial Court. They could not appear only on 01.04.2026 on account of some gap of communication with their counsel and by noting some wrong date of hearing. Their absence was not intentional but was due to the above reason. Now, they are ready to abide by the terms and conditions to be imposed HARJEET KAUR 2026.07.07 10:48 I attest to the accuracy and integrity of this document CRM-M-35448-2026 (O&M) -2- upon them and are willing to join the proceedings before the trial Court. It is, therefore, urged that the impugned order may be quashed. 3. Notice of motion. 4. Ms. Ruchika Sabherwal, learned Senior DAG, Punjab has advance notice of the petition and has submitted that there is no infirmity and illegality in the impugned order. Hence, the present petition does not deserve to be allowed. 5. This Court has heard the rival submissions made by learned counsel for the petitioners and has gone through the record. 6. On going through the record, it has been noticed that the petitioners did not appear before the learned trial Court on 01.04.2026. Their bail was cancelled due to that reason. Though, there is no illegality or infirmity in the impugned order, however, keeping in view the fact that the petitioners are now ready and willing to join the proceedings before the learned trial Court and their non-appearance does not appear to be intentional, the instant petition is disposed of by directing the petitioners to surrender before the learned trial Court on 18.07.2026 i.e. the date already fixed before it. On their doing so, they shall be admitted to bail on their furnishing fresh personal as well as surety bonds to the satisfaction of the trial Court. 7. A copy of this order be sent to learned trial Court for necessary compliance.
