The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 148/2026, registered at Police Station – Nawagarh, District Bemetara (C.G.) for alleged commission of offence punishable under Sections 420, 406, 467, 468, 471, 409 read with Section 34 of the Indian Penal Code. 2. Case of the prosecution, in brief, is that the applicant, who is alleged to be the Incharge Manager of the Seva Sahkari Samiti Maryadit Murta, Registration No. 1271 of Block Nawagarh, District Bemetara in 2 connivance with the other co-accused Amit Sahu has derived wrongful gain of Rs.57,01,454.40/-. It is alleged that although several farmers had already repaid their KCC loans, the loans were still shown as outstanding in the records despite the payments having been made. Furthermore, it is alleged that the applicant, in connivance with clerk Amit Sahu, breached the trust reposed in them by the farmers and embezzled a substantial amount of money, thereby committing the said offense. 3. Learned Senior Counsel appearing for the applicant submits that the applicant has been falsely implicated in the instant case. He submit that the subject dispute is pertaining to the year 2018 to 2023, however, the applicant/accused has joined the office in the same society in the year 2024 and, therefore, the applicant/accused is not liable to any wrongful act, if done, before his posting in the society. He submits that initially the applicant was granted interim protection by the trial Court, but subsequently his main bail application has been rejected by the trial Court stating that the applicant joined the investigation but he is not cooperating with the investigation. He submits that as per the allegation raised in the FIR, no custodial interrogation is required in the instant case and as such arresting the applicant would not serve the purpose, rather it will put a scar on his entire life, therefore, it is prayed that the applicant may be extended the benefit of anticipatory bail. 4. Per contra, counsel for the State vehemently opposes the prayer for grant of anticipatory bail to the applicant. 3 5. I have heard learned counsel for the parties and perused the material available on record. 6. Having heard learned counsel for the parties, having regard to the facts & circumstances of the case and considering the role of the applicant that he being the Manager of the Seva Sahkari Samiti Maryadit Murta, Block Nawagarh, District Bemetara and being a responsible person, in connivance with the clerk of that Society namely Amit Sahu, huge money of Rs. Rs.57,01,454.40/- has been misappropriated, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the Anticipatory Bail application of the applicant – Rajendra Pandey, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 148/2026, registered at Police Station – Nawagarh, District Bemetara (C.G.) for alleged commission of offence punishable under Sections 420, 406, 467, 468, 471, 409 read with Section 34 of the Indian Penal Code is hereby rejected.
