For Petitioner : Mr.R.Karunanidhi ORDER This Criminal Miscellaneous Petition has been filed, praying to suspend the sentence imposed on the petitioner by the Fast Track Court Judicial Magistrate, Karur, in S.T.C.No.525 of 2019, dated 05.07.2024, which was confirmed by the District and Sessions Court, Karur in C.A.No.185 of 2024, dated 07.02.2026. 2. The learned counsel for the petitioner would submit that the petitioner was convicted by the Fast Track Court Judicial Magistrate, Karur for the offence under Section 138 of the Negotiable Instrument Act and sentenced him to undergo Simple Imprisonment for a period of six months and to pay compensation of Rs.1,50,000/- to the complainant within a period of one month from the date of Judgment, and in default of payment of compensation, to undergo simple imprisonment for a period of one 2/7 https://www.mhc.tn.gov.in/judis Crl.MP(MD)No.9943 of 2026 month. Aggrieved by the same, the petitioner filed C.A.No.185 of 2024, before the District and Sessions Court, Karur and the lower Appellate Court vide order dated 07.02.2026, dismissed the appeal confirming the judgment passed by Trial Court. Aggrieved by the same, the petitioner has filed present the Criminal Revision Petition in Crl.RC(MD)No.857 of 2026 before this Court along with the instant miscellaneous petition seeking suspension of sentence and bail. 3. The learned Counsel for the petitioner would further submit that the petitioner has raised substantial grounds in the above revision, which requires consideration. Hence, he prayed for granting suspension of sentence and bail to petitioner. 4. Considering the fact that there are arguable points raised in revision and taking into consideration, facts and circumstances of the case and that it is also likely to take a while before the revision is 3/7 https://www.mhc.tn.gov.in/judis Crl.MP(MD)No.9943 of 2026 finally heard, this Court is inclined to grant suspension of sentence and bail, on the following conditions, till the disposal of the above Criminal Revision: i) The petitioner is directed to be enlarged on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned District and Sessions Judge, Karur; ii) The petitioner shall deposit a sum of Rs.50,000/- to the credit of S.T.C.No.525 of 2019 on the file of the Fast Track Court Judicial Magistrate (at Magistrate Level), Karur. iii) The petitioner and sureties shall affix their photographs and Left Thumb Impression in the bond and the above said Court may obtain a copy of their Aadhaar card or Bank pass Book to ensure their identity; 4/7 https://www.mhc.tn.gov.in/judis Crl.MP(MD)No.9943 of 2026 iv) The petitioner shall appear and sign before the District and Sessions Judge, Karur, on the first working day of every month at 10.30 a.m., until the disposal of the revision; v) In case, if the petitioner is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. (corresponding to 355 B.N.S.S) and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court. 5.
