..Respondents
Coram Hon’ble Mr Justice Rakesh Kainthla, Judge. Whether approved for reporting No.
For the petitioner : Mr. Rajesh Kumar, Advocate. . For the respondents : Mr. Jitender Sharma, Additional Advocate General.
Rakesh Kainthla,Judge(Oral)
Learned counsel for the petitioner after arguing the matter for some time has conceded that the complaint disclosed the commission of non-cognizable offences and Section 156(3) Cr.P.C. was not applicable, however, he submits that the learned trial Court should have taken cognizance of the commission of offences and proceeded as per the law. Since no prayer was made by the applicant/complainant before the learned trial Court to take cognizance, therefore, complainant/petitioner is free to file
2 a appropriate complaint seeking a prayer to take cognizance and proceed as per the law.
The present petition stands disposed of, so also the pending applications, if any.
