This is the 1st bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the Applicant who has been arrested in connection with Crime No.190/2025 registered at Police Station – Bagicha, District- Jashpur (C.G.), for the offences under Sections 105, SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.07.13 11:51:39 +0530

According to the prosecution story, on 02.09.2025 at about 11:30 PM, the Applicant was driving a Bolero vehicle bearing Registration No. CG-15-CR-1429 on the State Highway main road from Charaidand towards Bagicha near Jurudand, Bagicha. It is alleged that the Applicant, despite knowing that driving the vehicle at a high speed after consuming alcohol was likely to endanger human life and safety, drove the said vehicle in a rash, negligent and reckless manner and at an excessive speed while under the influence of alcohol. It is further alleged that due to such rash and negligent driving, the Applicant lost control of the vehicle and dashed against Arvind Kerketta, Vipin Kumar Prajapati and Khirowati Yadav, resulting in their death due to the injuries sustained in the accident. It is also alleged that the Applicant caused simple injuries to Bhuvaneshwari Yadav, Uma Yadav and Khushi Prajapati and grievous injuries to several other persons namely Rakesh Yadav, Sandeep Yadav, Pramod Yadav, Sandeep Prajapati, Devanti, Niranjan Ram, Hemant Yadav, Gayatri, Chanda Bai, Pinky Vishwakarma, Yahus Lakra, Parmanand Yadav, Fakir Ram, Abhimanyu Yadav, Hemanand Yadav, Neeru Yadav, Nahendra Yadav, Aarti Yadav and
3 Narayan Yadav by hitting them with the aforesaid Bolero vehicle. Based on the aforesaid allegations, the police registered the offences as mentioned above against the present Applicant. Hence, this application.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that there is no cogent material to establish that the Applicant was driving the vehicle in a rash and negligent manner or was under the influence of alcohol at the time of the incident. It is further submitted that the allegations of high speed and negligence are not supported by any scientific evidence or independent witness, he is in custody since 07.09.2025 and the trial is likely to take considerable time for its conclusion, therefore, it is prayed that he may be enlarged on regular bail.
4. On the other hand, learned State Counsel opposes the bail application and submits that in the alleged accident, 26 persons sustained injuries and three persons died, therefore, it is prayed that the bail application may be rejected.
5. Having considered the submissions advanced by learned Counsel for the parties and perused the case diary, the nature of allegations, the gravity of the offence, the fact that the alleged accident resulted in the death of three persons
4 and injuries to 26 persons and the allegation that the Applicant was driving the offending vehicle in a rash and negligent manner under the influence of alcohol, this Court is not inclined to grant bail to the Applicant at this stage.
6. Accordingly, the bail application of the applicant – Sukhsagar involved in Crime No. 190/2025 registered at Police Station – Bagicha, District- Jashpur (C.G.), for the offences under Sections 105, 115(2) & 117(2) of BNS as also under Sections 184 & 185 of MV Act is hereby rejected.
7. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information.
