JUSTICE H.T. NARENDRA PRASAD ORAL ORDER In this petition, the petitioner has sought the following reliefs: “i. Issue a writ/order/direction under Articles 226 and 227 of the Constitution of India, directing the Hon'ble Court of the City Civil and Sessions Judge, Bengaluru, seized of A.Α.No.46/2025 filed under Section 9 of the Arbitration and Conciliation Act, 1996, to take up and hear I.A.No.1 Annexure-B (Application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, 1908) on an urgent basis and dispose of the same within a fixed outer time limit, in any event on or before a date to be specified by this Hon'ble Court, and thereafter proceed to hear and dispose of the main petition expeditiously; ii. in the alternative, issue a writ/order/direction directing the said Court to advance the hearing of A.Α.Νο.46/2025, presently posted to 17.03.2026, and to list the matter at the earliest available date prior thereto and proceed to hear the interim application and the main petition without granting avoidable adjournments; - 4 - HC-KAR NC: 2026:KHC:18810 WP No. 10931 of 2026 iii. pass such other order(s) or direction(s) as this Hon’ble Court may deem fit, including costs, in the interest of justice and equity.” 2. The petitioner has filed an arbitration case in A.A.No.46/2025 under Section 9 of the Arbitration and Conciliation Act, 1996 (‘Act’ for short). On service of summons, the respondents appeared and filed objections. So far, no order has been passed on the arbitration application. Hence, the petitioner is seeking for early disposal of the arbitration application. 3. In view of the above, without expressing any opinion on the merits of the case, this writ petition is disposed of directing the Trial Court to dispose of A.A.No.46/2025 filed under Section 9 of the Act as expeditiously as possible, not later than end of June 2026.
