CRM-M-34171-2026 -1- IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 230 CRM-M-34171-2026 Date of decision : 07.07.2026 SUKHPREET SINGH @ PREET ... PETITIONER Versus STATE OF PUNJAB .. RESPONDENT CORAM : HON'BLE MR. JUSTICE H.S.GREWAL Present:- Mr. J.S. Sandhu, Advocate for the petitioner. Mr. Subhash Godara, Addl. A.G., Punjab. *** H.S. Grewal, J.(Oral) 1. This petition has been filed by the petitioner under Section 483 BNSS, 2023 (corresponding Section 439 Cr.P.C.) for grant of regular bail in case FIR No.33 dated 21.07.2024, under Sections 103 & 3(5) of BNS, 2023 (erstwhile Sections 302 & 34 IPC), registered at Police Station Nandgarh, District Bathinda. 2. The case of the prosecution is that on the intervening night of 20/21.07.2024, the complainant came to know that his son, namely, Vicky Kumar had been tied up in the house of Sukhpreet Singh (petitioner). Upon this, the complainant along with his wife and son Rinku reached there, then Baljinder Singh closed the door of the room. Looking through a broken window, the complainant saw that Vicky Kumar was tied on a bed with a rope. Co-accused Baljinder Singh armed with a wooden log, Gurmail Singh armed with a spade, Sukhpreet Singh (petitioner) armed with a dang and co-accused SONIA GUGNANI 2026.07.07 17.11 I attest to the accuracy and integrity of this document Chandigarh CRM-M-34171-2026 -2- Lovepreet Singh armed with a wooden log, were giving severe beatings to Vicky Kumar and as a result thereof, he succumbed to his injuries. It is also alleged that the wife of the petitioner was having illicit relations with deceased- Vicky Kumar, who used to visit the house of the petitioner to meet her. On the day of the alleged occurrence, the petitioner allegedly found the deceased present in his house, therefore, the incident in question took place. 3. Learned counsel for the petitioner, however, submits that the petitioner has been falsely implicated in this case and nothing has been recovered from him. It is submitted that co-accused Gurmail Singh, Lovepreet Singh @ Labhi @ Deshpreet Singh and Baljinder Singh @ Lali have already been granted bail by this Court in CRM-M-65150-2025, CRM-M-16907-2026 & CRM-M-18809-2026 on 18.03.2026, 06.04.2026 & 16.04.2026 (Annexures P-3 to P-5 respectively). He also submits that the petitioner is in custody for the last more than 01 year, 11 months and 12 days and is not involved in any other case. Learned counsel, therefore, prays for release of the petitioner on regular bail as the trial is likely to take a long time as out of total 25 cited prosecution witnesses, 04 have been given up and only 06 have been examined so far. 4. Notice of motion. 5. On the asking of the Court, Mr. Subhash Godara, Addl. A.G., Punjab, accepts notice on behalf of the respondent and vehemently opposes the prayer for grant of regular bail to the petitioner. He has filed the custody certificate of the petitioner in Court, which is taken on record. As per the custody certificate, the petitioner is in custody for the last more than 01 year, 11 months and 12 days. He, upon instructions, submits that out of total 25 cited SONIA GUGNANI 2026.07.07 17.11 I attest to the accuracy and integrity of this document Chandigarh CRM-M-34171-2026 -3- prosecution witnesses, 04 have been given up and only 06 have been examined so far. 6. I have heard the learned counsel for the parties and perused the record. 7. In view of the above submissions of learned counsel for the parties and keeping in view the facts that the petitioner is in custody for the last more than 01 year, 11 months and 12 days, he is not involved in any other case, co-accused(s) have already been granted bail and that the trial is likely to take a long time as out of total 25 cited prosecution witnesses, 04 have been given up and only 06 PWs have been examined so far, therefore, this Court deems it appropriate to grant the concession of regular bail to the petitioner during the pendency of the trial as the continuous detention of the petitioner would not serve the ends of justice. 8. 8. Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/Chief Judicial Magistrate concerned. 9. However, it is made clear that in case the petitioner misuses the concession of bail, the State/complainant would be at liberty to seek cancellation of his bail.
