THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO: 5095/2013
ORDER:
This Writ Petition under Article 226 of the Constitution of India is filed for the following relief:
“..pleased to issue a Writ of Mandamus, or any other appropriate writ, order or direction, declaring the action of the 2nd Respondent in stopping issuance of Transit Permits in relation to the mining lease granted vide Proceedings No.3816/M/2002, Dt.7.12.2004 for mining Laterite without providing reasonable time for obtaining clearance from the Pollution Control Board as illegal and arbitrary..”
2. The petitioner had challenged the action of the 2nd respondent in stopping the issuance of transit permits in respect of the petitioner’s lease, which was granted vide proceedings No.3816/M/2002 dated 07.12.2004. 3. On perusal of the docket order, it is observed that the matter was adjourned on 03.02.2026 at the instance of the learned counsel for the petitioner. Thereafter, it was again adjourned on 10.02.2026 to today. Today also, there is no representation on behalf of the petitioner. 4. On the other hand, Smt. M. Anusha, learned Assistant Government Pleader submits that the main grievance of the petitioner is only regarding the non-issuance of transit permits during the subsistence of the petitioner’s lease period. She further submits that, relying on the material paper (Ex.P.1), the
4
lease was granted in favor of the petitioner for a period of twenty years commencing from 17.12.2004 up to 06.12.2024. 5. In view of the afflux of time, the lease period has now expired, and therefore, the cause of action in the present Writ Petition does not survive. 6. Considering the absence of representation on behalf of the petitioner, coupled with the submissions made by the learned Assistant Government Pleader, the writ petition is dismissed. There shall be no orders as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _____________________________ MAHESWARA RAO KUNCHEAM,J 17.02.2026
