Learned AGA accepts notice for respondents No.1 to 3. 2. The petitioner son of H.V.Puttaraju (CTP No.79/26) is before this Court seeking the following reliefs: (a) Issue a writ order or direction in the nature of Mandamus to the respondents to grant Emergency parole of 30 days to the convict Puttaraju H.V. @ Putti S/o - 3 - HC-KAR NC: 2026:KHC:32941 WP No. 19820 of 2026 Venkatesha (bearing CTP No.79/26). (b) Pass such other orders/directions considering the facts and circumstances of the case, together with costs in the interest of justice. 3. The detenu was convicted for offences punishable under Sections 144, 148, 302 r/w 149 of IPC on 01.04.2026 for imprisonment for life by the II Additional District and Sessions Judge, Hassan in S.C.No.49/2010. The detenue has undergone judicial custody for a period of 9 months 13 days and in all has been incarcerated for a period of 11 months 20 days. The petitioner has submitted an application for Emergency Parole on the ground that his mother is suffering from psychic problem. She has been advised complete bed rest since she had attempted suicide and injured her hand. The said application was rejected on the ground that there being serious offences as regards which the proceedings had been taken up. The detenu having - 4 - HC-KAR NC: 2026:KHC:32941 WP No. 19820 of 2026 only be incarcerated for a short time. It is in that background that the petitioner is before this court. 4. Emergency parole would be granted when there is an actual emergency. In the present case, the contention of the petitioner is that his mother suffers from psychic problem and is terminally ill. The certificate which has been issued requires to be verified inasmuch as a psychic condition cannot be considered to be terminally ill. Apart therefrom the contention of the petitioner being that his mother requires support, the petitioner being the son is always available for such support and is not required for the detenu to be granted emergency parole on that ground. 5. In that view of the matter, the petition stands dismissed. 6. The second respondent is directed to cause an enquiry into the medical certificate issued at - 5 - HC-KAR NC: 2026:KHC:32941 WP No. 19820 of 2026 'Annexure-B' and submit an enquiry report within four weeks from today.
