Learned advocate appearing for the petitioner submits that petitioner is better placed than the other accused, namely, Selim Ostagar who has been granted bail in CRM(NDPS) 41 of 2026. 2. Learned advocate for the State opposes the prayer for bail and submits that there are criminal antecedents of the present petitioner and is charged in other cases of dacoity and murder. It has been submitted that petitioner is already in custody in connection with a case under Section 302 of the Indian Penal Code, 1860. However, so far as the present case is concerned, the petitioner has been behind the bars for more than a year. Another accused has been granted Page 2 bail. There is no recovery from the present petitioner and he has been implicated on the basis of statement of co- accused and other materials collected by the investigating agency. 3. Having considered the totality of the circumstances and the subject matter involving 10 litres of codeine mixture/cough syrup, I am inclined to release the petitioner on bail. 4. Accordingly, the prayer for bail of the petitioner is allowed. 5. As such, the petitioner, namely, Goutam Ghosh @ Guru shall furnish bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court, NDPS Act, 8th Court at Barasat, North 24 Parganas. 6. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court in seisin of the case. The petitioner shall not leave the district of North 24 Parganas without prior permission of the concerned Court. 7. Accordingly, CRM(NDPS) 1339 of 2026 is disposed of. 8. Memo of evidence filed by the State be kept with the record. 9. Case diary be returned to the learned advocate appearing for the State. 10.
