Respondent(s) Through: Coram: Hon’ble Mr. Justice Sanjay Dhar, Judge ORDER 07.08.2026 The petitioner, through the medium of present petition is aggrieved of order dated 03rd March 2026 passed by the learned trial court whereby he has been declared as absconder and proceedings under Section 335 of BNSS have been initiated against him. Vide the impugned order, general warrants of arrest have also been issued against the petitioner. Learned counsel for the petitioner has submitted that the petitioner was not having knowledge about the presentation of charge sheet by respondent No. 1 and in fact no notice was served upon him at the time of filing of the charge sheet. The learned counsel has submitted that the petitioner is ready to surrender before the trial court provided, he is granted some protection till he applies for bail before the learned trial court. In view of the nature of the controversy involved in this petition, the same can be disposed of at the threshold itself by giving liberty to the petitioner to approach the learned trial court for grant of bail and for cancellation of warrants of arrest issued against him in terms of the impugned order. In case the petitioner surrenders before the trial court within a period of ten days from today, the learned trial Magistrate shall not proceed to take coercive measures against him till the application for grant of bail and cancellation of warrants that may be filed by the petitioner is considered and decided by the said court.
