1 CGHC010210682026 2026:CGHC:28993 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 4928 of 2026 Dipesh Kumar Shah S/o Chhote Lal Shah Aged About 32 Years (Wrongly Mentioned As Sahu In A/1) R/o Majhaoli, P.S. Baidhan, District Singraoli (M.P.) ... Applicant versus State Of Chhattisgarh Through Station House Officer, Police Station Patna, District Koriya (C.G.) ---- Non-Applicant For Applicant : Mr. Rajnish Singh Baghel, Advocate For Non-Applicant : Ms. Supriya Upsane, Government Advocate Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 10/07/2026 1. This is the first bail application filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 85/2025 registered at Police Station-Patna, District-Koriya, for the offence punishable under Section 20 (B) of the Narcotic Drugs & Psychotropic Substances Act, 1985. 2. As per the prosecution case, on the basis of information received KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 from the informer on 12.04.2025, the police officials were informed that a person travelling in a white-coloured pick-up vehicle was transporting a contraband article, allegedly concealed in the trolley of the pick-up vehicle, from Surajpur Shivnagar towards village Tengani. Acting upon the said information, the police officials intercepted and stopped the said pick-up vehicle. During the search of the vehicle, the police allegedly recovered 90 packets containing Cannabis (ganja), weighing a total quantity of 92 kg and 340 grams. Accordingly, the police registered FIR/Crime No. 85/2025 against the present applicant for offences punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 3. Learned counsel for the applicant would submit that the applicant has not committed any offence and he has been falsely implicated in crime in question. He would further submit that the applicant is in jail since 12.04.2025, charge-sheet has been filed, the case is pending in the Court of Special Judge, NDPS Act, Baikunthpur, District Koriya and conclusion of the trial is likely to take some time. Therefore, he prays that the applicant may be enlarged on regular bail. 4. Learned Government Advocate appearing for the State/non- applicant would oppose the bail application and submit that the quantity of Ganja seized is above the commercial quantity. She further submits that the trial is under progress and as such, the applicant is not entitled to be released on bail. 3 5. I have perused the bail application and have also gone through the case diary with the assistance of the learned State counsel. 6. From perusal of the case diary, it transpires that the psychotropic substance seized from the possession of the applicant is 92 kg and 340 grams which is above the commercial quantity and the applicant has unable to give any plausible explanation with regard to the alleged recovery and further that the trial is in progress, I do not find it a fit case to release the applicant on regular bail. 7. Accordingly, the bail application of the applicant-Dipesh Kumar Shah filed under Section 483 of the BNSS, involved in Crime No.85/2025 registered at Police Station-Patna, District-Koriya, for the offence punishable under Section 20(B) of the Narcotic Drugs & Psychotropic Substances Act, 1985, is rejected at this stage. 8. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial in accordance with law as expeditiously as possible, preferably within a period of six months from today, if there is no legal impediment. 9. Office is directed to send a copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/- (Ramesh Sinha) CHIEF JUSTICE Kunal
