JUSTICE ARUN DEV CHOUDHURY ORDER 23-03-2026 1. None appears for the petitioner even on the second call. 2. Heard Mr. S. Dutta, learned Standing counsel, P&RD Department for the respondents. 3. The grievance of the petitioner is that a departmental proceeding was initiated against him on 13.03.2019 and is yet to be concluded without any valid reason. 4. This Court under its order dated 29.01.2025, observed that pendency of this writ petition shall not constitute a bar for the authorities to take appropriate decision in the matter in accordance with law, if so advised. Page No.# 3/3 5. In the aforesaid backdrop, this Court asked Mr. S. Dutta, learned Standing counsel, P&RD Department to complete his instruction as regards the status of the departmental proceeding. 6. On instruction, Mr. Dutta, learned Standing counsel, P&RD Department submits that the enquiry has already been completed and the Enquiry Officer has also submitted his report to the employer and that the employer is contemplating to furnish a copy of the aforesaid enquiry report along with second Show-Cause notice to the petitioner within a week from today. 7. Mr. Dutta, learned Standing counsel, P&RD Department further submits that after receipt of the reply of second Show-Cause notice, the authority shall proceed the matter in accordance with law and it is expected that in the event, the petitioner files reply to second Show-Cause notice within the stipulated time, the entire proceeding shall be completed within a period of one month thereafter. 8. In view of the aforesaid, the present writ petition stands closed, having no surviving cause of action. JUDGE Comparing Assistant
