Heard Learned Counsel Mr. R. Gope appearing for the petitioner and also heard Learned D.S.G.I. appearing for the respondents. The petitioner has filed the writ petition seeking following reliefs: i. Issue a writ in the nature of Mandamus directing the Respondents to incorporate the name of the Petitioner in the final select list and consequent thereto issue offer of appointment to the petitioner forthwith. ii. Issue a writ in the nature of Mandamus directing the Respondents to issue the joining letter to the Petitioner who has duly passed all the Recruitment tests under the Constable (GD) in Central Armed Police Forces (CAPFs), SSF Rifleman (GD) in Assam Rifles and Sepoy in Narcotics Control Bureau Examination-2025. iii. Pending disposal of the present writ petition, pass an interim order directing the Respondents to keep one post vacant in the relevant category for the Petitioner. At the time of hearing Learned Counsel for the petitioner drawn the attention of the Court that in spite of requisite qualifications and after participating in the process of selection against advertisement notice dated 05.09.2024 the candidature of the petitioner was not considered by the respondents authority and as such the petitioner has approached this Court seeking the reliefs.
Learned D.S.G.I. appeared on behalf of the respondents and drawn the attention of the Court by showing column No.5 of the employment notice dated 05.09.2024 wherein regarding age limit it was specifically mentioned that as per DOPT circular dated 14.07.1998, in the said advertisement notification it was specifically mentioned that on 01.01.2025 the age of the candidate should be in between 18-23 years i.e. the candidates

should be born not before 02.01.2002 and not later than
01.01.2007. But as per Annexure-4 the date of birth of the petitioner is mentioned as 25.09.2021. Thus the petitioner fails to fulfill the criteria in respect of age against the said notification and as such there is no scope to accept his candidature as an eligible candidate for the alleged post against the said notification dated
05.09.2024. Since the petitioner at the time of hearing failed to satisfy the Court regarding the age of the petitioner within the stipulated period as indicated above and as such I do not find any merit in the writ petition filed by the petitioner and accordingly the writ petition stands dismissed being devoid of merit. Pending application, if any, stands disposed of. JUDGE
