The petitioners are apprehending their arrest in connection with Radhanagar P.S. Case No.273/2025, registered for the offence under Sections 137(2), 96, 3(5) of the BNS, pending in the Court of the learned Judicial Magistrate, Rajmahal. 3. Learned counsel appearing for the petitioners submits that the father of the victim girl has lodged the FIR alleging that his daughter was taken out forcefully by the petitioners. He further submits that now a good sense has prevailed between the parties and compromise has reached between them and pursuant to that, marriage has been solemnized between petitioner no.1 and the victim. He submits that petitioner no.2 is the brother of petitioner no.1. He then submits that the compromise petition has been brought on record by way of filing I.A. No.2 of 2026. 4. Learned counsel appearing for the State opposed the prayer and submits that it appears that now the marriage has been solemnized in light of the said I.A. ( 2026:JHHC:22 ) -2- A.B.A. No. 7400 of 2025 5. Learned counsel appearing for the informant submits that in view of the compromise, the marriage has been solemnized between petitioner no.1 and the victim. He further submits that the said I.A. has been filed on separate affidavits on behalf of both the sides. 6. In view of the above and considering that the marriage has been solemnized between petitioner no.1 and the victim in terms of the compromise and petitioner no.2 is the brother of petitioner no.1 and the said compromise has reached between the petitioners and the informant, which has been filed in the form of I.A. No.2 of 2026 and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners. 7. Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Rajmahal in connection with Radhanagar P.S. Case No.273/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 8. Pending I.A., if any, is disposed of. (Sanjay Kumar Dwivedi, J.)
