learned counsel for the petitioner, seeks permission of this Court to withdraw the present Criminal Petition.

4. In view of the above, the Criminal Petition is dismissed as withdrawn. However, since the offence alleged against the petitioner is Section 118(1) of Bharatiya Nyaya Sanhita, 2023, the police shall follow the procedure prescribed under Section 35 (3) of Bharatiya Nagarik Suraksha Sanhita, 2023, [Section 41-A Cr.P.C] and the guidelines laid down by the Hon’ble Supreme Court in Arnesh Kumar v.
