1 CGHC010190022026 2026:CGHC:28768 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 4747 of 2026 Deepak Dewar @ Deepak Naidu S/o Chandrashekhar Naidu Aged About 38 Years R/o Fish Market Khursipar Bhilai District Durg (C.G.) ... Applicant versus State Of Chhattisgarh Through- Station House Officer, P.S.- Jamul District- Durg (C.G.) ... Non-Applicant For Applicant : Shri AC Sahu, Advocate. For Non-Applicant : Miss Ritika Verma, PL. Hon'ble Shri Ramesh Sinha , Chief Justice Order on Board 09/07/2026 1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.76/2026 registered at Police Station Jamul, District Durg (C.G.) for the offence under Section 20 (B), 27(A) & 29 of the NDPS Act. KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.07.13 13:12:38 +0530 2 2. Case of the prosecution is that on 3.2.2026, the concerned Police received information from the informant that Domesh Kumar Thakur and Abhay Shukla were possessing narcotic substance near the college in Shivpuri, Jamul and were searching customers for sale and thereafter the police conducted a raid and apprehended the present applicant and co-accused persons and seized 1.770 kg of Cannabis and 11 small paper packets from co- accused Domesh Kumar Thakur. Thereafter the offence was registered against the present applicant. Hence the bail application. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. Nothing has been recovered from exclusive possession of the applicant. The applicant has been arrested only on the basis of memorandum of co-accused. However, learned counsel for the applicant submits that the applicant has 3 criminal antecedents registered against him (one under the NDPS Act & 2 cases under the Excise Act), which are pending. The applicant is in jail since 3.2.2026. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that the charge sheet has already been filed against the applicant. She does not dispute the fact that the applicant has 3 criminal antecedents registered against him (one under the NDPS Act & 2 3 cases under the Excise Act), which are pending. Therefore, the present bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and the fact that the charge sheet has already been submitted against the applicant and that the applicant has 3 criminal antecedents registered against him (one under the NDPS Act & 2 cases under the Excise Act), which are pending, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of applicant – Deepak Dewar @ Deepak Naidu, involved in Crime No.76/2026, registered at Police Station Jamul, District Durg for the offence punishable under Section 20 (B), 27(A) & 29 of the NDPS Act, is rejected. - Sd/- (Ramesh Sinha) Chief Justice Barve
