1 CGHC010226412026 2026:CGHC:29308 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 5722 of 2026 A B C S/o X Y Z , Aged About 16 Years (Age Not Mentioned In The Impugned Order) ... Applicant(s) versus State Of Chhattisgarh Through Police Station - Mana Camp, Dist. - Raipur (C.G.) ... Non-Applicant(s) For Applicant(s) : Mr. Anchal Kumar Matre, Advocate. For Non-Applicant(s) : Ms. Smriti Shrivastava, Panel Lawyer. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 13.07.2026 1. Heard. 2. The present bail application has been filed by the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023. In the present application, the applicant has projected himself to be a juvenile at the time of the alleged incident and on the said premise, has concealed his identity by describing himself as "ABC" throughout the bail application. 3. From perusal of the impugned order dated 29.05.2026 reveals that the learned trial Court has specifically rejected the contention of the applicant regarding his claim of juvenility by observing that no KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 material whatsoever was placed on record to establish that the applicant was about 16 years of age at the time of the incident. The learned trial Court, after recording the said finding, also rejected the bail application on merits. Furthermore, the name and identity of the applicant have been specifically mentioned in the impugned order. 4. Despite the aforesaid factual position, the present bail application has been filed before this Court by concealing the identity of the applicant on the premise that he is a juvenile. An objection in this regard has also been raised by the Registry. 5. In view of the aforesaid facts and circumstances, particularly when the applicant has failed to establish his claim of juvenility before the learned trial Court and has filed the present bail application by concealing his identity contrary to the findings recorded in the impugned order, this Court is not inclined to entertain the present bail application. 6. Accordingly, the present bail application is dismissed on this ground alone, with liberty to the applicant to file a fresh bail application, if so advised, after curing the defects and complying with the applicable Rules. 7. The Registry is directed to return the certified copy of the impugned order, if filed along with the present bail application, to the learned counsel for the applicant after retaining a photocopy thereof on record. - Sd/- (Ramesh Sinha) CHIEF JUSTICE Kunal
