1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.221/2026 registered at Police Station Kotwali District Rajnandgaon (C.G.) for the offence under Sections 34 (2) & 59 KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.07.13 11:52:24 +0530

2. The prosecution case, in brief, is that on 20.4.2026, based on the information received from the informant that the applicant has dumped a large quantity of liquor manufactured in Madhya Pradesh at his house and is about to take it out for immediate sale, the concerned police has conducted a raid and recovered a bag which contained 161 quarter bottles of Indian made Foreign liquor labelled as Bombay Special Whisky manufactured in Madhya Pradesh 180 ml, totalling 28.980 bulk liters, valued at Rs.21,735/-. Thereafter the FIR was registered against the applicant. Hence the bail application.
3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. Investigation is already complete and charge sheet has already been filed. The applicant has 3 criminal antecedents under the IPC and Excise Act, out of which 2 cases have already been
disposed of and one case under the Excise Act is pending. The applicant is in jail since 20.4.2026. Therefore, the applicant may be released on bail.
4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that the applicant has 2 criminal antecedents under the Excise Act registered in the year 2023, which are pending, and the charge
3 sheet has been submitted against the applicant. Therefore, the bail application may be rejected.
5. I have heard learned counsel appearing for the parties and perused the case diary.

Taking into consideration the facts and circumstances of the case, and the fact that the charge sheet has already been submitted against the applicant and the applicant has 2 criminal antecedents under the Excise Act registered in the year 2023, which are pending, this Court is of the view that the applicant is not entitled to be released on bail in the present case.
7. Accordingly, the bail application of applicant – Lokesh Kumar Sinha, involved in Crime No.221/2026, registered at Police Station Kotwali, District Rajnandgaon for the offence punishable under Section 34 (2) & 59 (A) of the Excise Act, is rejected.
