The present petition has been filed for grant of following substantive reliefs:
“1. It is therefore respectfully prayed that this petition may kindly be allowed and ld. Additional Distt. Judge-II Solan, H.P. may kindly be directed to decide the application under
Order 39 Rules 1 & 2 within 2 weeks or any such shorter time which this Hon’ble Court deems fit and proper.
2. That Additional Distt. Judge-II, Solan may kindly be
directed to decide the Civil Suit being Civil Suit No. 1-s/1 of 2024/22 (1-2024)”

It is contended by learned counsel for the petitioner that the original civil suit was filed before this Court and in that civil suit, plaintiffs/respondents, in an application under Order 39 Rules 1 and 2 CPC, got an ad interim order in their favour. It is further contended that her only grievance in the instant petition is that the application, under Order 39 Rules 1 and 2 CPC, which is still pending, has not been decided despite passing of more than 4 years and appropriate directions may be given to the learned trial court to decide the same. 3
Without touching merits of the case, the instant petition is disposed of with a direction to the learned trial court to decide the application under Order 39 Rules 1 and 2 CPC within a period of four weeks positively from today. 4
Pending application(s), if any, also stands disposed of.
