GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the Respondents No. 2 to 5 in opening the History Sheet (Hired assassin No. 890) against the petitioner which was transferred from Proddatur Rural Police Station, YSR Kadapa District and continuing in II Town Police Station, Nawabpet, Nellore Town, SPSR Nellore District, as illegal, arbitrary, violative of AP Police Standing Orders and contrary to the Principles of Natural Justice and violation of Articles 14 and 21 of the 2 constitution of India and consequently direct the respondents to close the History sheet(Hired assassin No. 890) against the petitioner to consequently set aside the same by directing the respondents No. 2 to 5 to close the History Sheet (Hired assassin No. 890) in II- TownPolice Station, Nawabpet, Nellore Town, SPSR Nellore District, against the petitioner.” 2. Sri G.Vijaya Saradhi, learned counsel for the Petitioner would submit that, no cases are pending against the Petitioner and hence, the impugned suspect sheet may be set aside. 3. Sri P.Ajay Babu, learned Assistant Government Pleader for Home by way of counter, would submit that no cases are pending against the Petitioner and to curb and curtail the unlawful activities of the Petitioner in the vicinity of Proddatur Rural Police Station, the History Sheet was opened against the Petitioner. 4. Considering the submissions made and since no material is placed before the Court to show that the behavior of the Petitioner is a threat to the public peace in the vicinity, the Writ Petition is allowed and the impugned History Sheet against the Petitioner is hereby set aside. There shall be no order as to costs.
