Learned counsel appearing on behalf of Jaspreet Singh @ Jehari @ Jarashpreet Singh, petitioner in CRM-M-23769-2026 submits that the petitioner was not even present at the place of alleged occurrence and has been falsely involved in the present case. He further submits that as per the case set up by the prosecution, the petitioner was allegedly carrying a dattar and gave blows on the head, left hand fingers and backside of the complainant. It has been also alleged that he had snatched an amount of Rs.12,000/- from the complainant in the present case. Further, the injured in the present case has already been discharged from the hospital and is hale and hearty. After completion of investigation, challan has been presented against the petitioner and the petitioner is not in a position to influence the witnesses of the prosecution. Learned counsel further submits that the wife of the petitioner is at an advance stage of pregnancy and at this crucial time, the presence of the petitioner would be required by her. 4. On the other hand, learned counsel appearing on behalf of Gurpreet Singh @ Gora, petitioner in CRM-M-28290-2026 has raised similar arguments. It has been alleged that the petitioner was carrying a dattar and gave blows on HEMLATA 2026.07.06 17:37 I attest to the accuracy and integrity of this document CRM-M-23769-2026 (O&M) -5- the head and right side stomach of the complainant, Sant Kumar and also allegedly snatched a gold chain about 3 tolas from his person. He further submits that the petitioner was arrested in the present case on 21.02.2026 and is in custody for the last more than 04 months. 5. On the other hand, learned State counsel, assisted by learned counsel for the complainant have vehemently opposed the submissions made by learned counsel for the petitioners on the ground that serious allegations have been levelled against both the petitioners and they had caused serious injuries to the complainant with lethal weapons. Moreover, the prosecution evidence is yet to be recorded and the petitioners might influence the witnesses of the prosecution. However, learned State counsel is not disputed the fact that the injured has already discharged from the hospital and both the petitioners are the first offenders. 6. I have heard the learned counsel for the parties and perused the record. 7. No doubt, the allegations levelled against both the petitioners are serious in nature, however, they are stated to be in custody for the last more than 04 months. After completion of investigation, challan has already been presented against them and there is no material on record to show that the petitioners may abscond from the process of law or may influence the witnesses of the prosecution. Still further, both the petitioners were never involved in any other criminal activity. 8. Without commenting on the merits of the case, the present petitions are allowed and the petitioners are ordered to be released on bail subject to their HEMLATA 2026.07.06 17:37 I attest to the accuracy and integrity of this document CRM-M-23769-2026 (O&M) -6- furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned.
