JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners – accused Nos.1 to 3 are before this Court calling in question proceedings in C.C.No.51695/2019, pending before the XLIII Additional Chief Metropolitan Magistrate, Bengaluru, for the offences punishable under Sections 143, 448, 498A, 323, 341, 504, 506 and 149 of the IPC. 2. Learned counsel for the petitioners and respondent No.2 in unison submit that during the pendency of the petition, the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and conditions. They have filed a compromise petition / application under Sections 359 r/w. 528 of the BNSS along with a joint affidavit before this Court seeking permission to compound the offences. 3. The compromise petition / application reads as follows: “2. It is submitted that the allegation in the charge sheet is that on 08.01.2018 at about 5.00 pm, the Petitioners and other accused persons allegedly, went to the house of Respondent No.2, abused CW-1 to CW-3 in filthy language, assaulted them and gave life threat to them. - 4 - HC-KAR NC: 2026:KHC:31647 CRL.P No. 8383 of 2026 3. It is submitted that the above criminal proceedings arose out of matrimonial and family disputes between the daughter of Respondent No.2 and her husband and his family members The Petitioners are relatives/family members connected with the said matrimonial and family dispute and have been arrayed as accused in the above case. 4. It is submitted that during the pendency of the above Criminal Petition, at the intervention of elders, well- wishers, family members and responsible persons, the parties have amicably settled all their disputes. Respondent No.2 Susainathan does not intend to proceed further with the criminal case against the Petitioners. 5. It is submitted that the compromise arrived at between the Petitioners and Respondent No.2 Susainathan is voluntary, lawful and genuine. The same has been entered into without any force, threat, coercion, undue influence, pressure or misrepresentation from any person whomsoever. 6. Respondent No.2 Susainathan submits that he has no objection for this Hon'ble Court to record the compromise and to quash the entire proceedings in C.C. No.51695/2019 pending on the file of the Hon'ble XXIX Additional Chief Metropolitan Magistrate at Mayo Hall, Bengaluru, arising out of Crime No.11/2018 of Viveknagar Police Station, Bengaluru, insofar as the Petitioners are concerned. 7. It is submitted that the parties have resolved their personal, matrimonial and family disputes and there is no surviving grievance between the Petitioners and Respondent No.2. Is view of the settlement, - 5 - HC-KAR NC: 2026:KHC:31647 CRL.P No. 8383 of 2026 continuation of the criminal proceedings would not serve any useful purpose and would amount to abuse of the process of law. 8. It is submitted that though some of the offences alleged are non-compoundable in nature, the dispute is essentially personal, matrimonial and family in nature, and the parties having amicably resolved the matter, this Hon'ble Court may be pleased to exercise its inherent powers under Section 482 of the Code of Criminal Procedure to secure the ends of justice. 9. Hence, this application is filed seeking the kind permission of this Hon'ble Court to record the compromise entered into between the Petitioners and Respondent No.2 Susainathan and consequently allow the Criminal Petition by quashing the proceedings in the interest of justice and equity. Wherefore, this hon'ble court be pleased to accord permission to compound the offences in C.C. No.51695/2019 pending on the file of the Hon'ble XXIX Additional Chief Metropolitan Magistrate at Mayo Hall, Bengaluru (Crime No.11/2018 by Viveknagar Police Station) for the offences Punishable under section 143, 448, 498A, 341, 323, 504, 506 read with Section 149 of the Indian Penal Code.and consequently be pleased to allow the main petition filed under section 482 of CrPC as prayed for therein in the interest of justice and equity.” In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the terms as afore-quoted and terminate - 6 - HC-KAR NC: 2026:KHC:31647 CRL.P No. 8383 of 2026 the proceedings against the petitioners, as the allegations are not against the State. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The proceedings in C.C.No.51695/2019, pending before the XLIII Additional Chief Metropolitan Magistrate, Bengaluru, qua the petitioners, stand quashed.
