KAMAL Digitally signed by SUMA B N Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2026:KHC:32050 WP No. 9863 of 2022 ORAL ORDER The petitioner-Trust represented by one Sri.Someshwaranatha Swamiji is before this Court seeking issuance of writ of mandamus to the respondent-Bank to consider the request of the petitioner as per Annexure-A dated 09.01.2017 and also to direct the respondent-Bank to transfer the fixed deposit amount held in the names of (1) Smt. Puttaveeramma Adhyathmika Ashrama Trust, (2) Smt. Puttaveeramma Ashrama Trust and (3) Smt. Puttaveeramma Deaf and Dumb Children Residential School, to the account of Smt. Adichunchanagiri Puttaveeramma Trust's account maintained in the said bank. 2. Learned counsel for the petitioner submits that one Smt. Puttaveeramma had created several trusts and had deposited money in the name of said trust in the account maintained by her in the respondent-bank. During her lifetime, she had merged all the trusts into one single trust in name of Sri. Adichunchanagiri Puttaveeramma Trust, Mysore. That Sri.Someshwaranatha Swamiji who is representing the petitioner -Trust herein was the Secretary of the said trust created by said Smt. Puttaveeramma. That for the purpose of - 3 - HC-KAR NC: 2026:KHC:32050 WP No. 9863 of 2022 convenience and proper utilization of the funds after demise of said Smt. Puttaveeramma, the said Sri.Someshwaranatha Swamiji the representative of the present petitioner-Trust had approached the bank seeking transfer of the amount deposited into one single account of Smt. Adichunchanagiri Puttaveeramma Trust, Mysore which has been declined. Hence, the petition. 3. Learned counsel for the respondent on the other hand submits that the respondent-bank is not averse to consider the case of the petitioner. That if necessary documents supporting the claim of the petitioner regarding merging of several trusts which were created by Smt Puttaveeramma into one single trust namely Smt. Adichunchanagiri Puttaveeramma Trust are produced to the satisfaction of the Bank, the same will be considered in accordance with law. Since the petitioner had not furnished the documents as requisitioned by the bank, the request made by the petitioner could not be accorded. 4. At this juncture, learned counsel for the petitioner submits that liberty be reserved to the petitioner to furnish necessary documents to the respondent-Bank with a fresh - 4 - HC-KAR NC: 2026:KHC:32050 WP No. 9863 of 2022 representation and a direction to the respondent-bank to consider the same and pass appropriate order in accordance with law be issued. 5. Submission is placed on record. 6. Accordingly, the writ petition is disposed of. Petitioner is at liberty to submit fresh representation along with documents supporting the request being made for the purpose of transfer of amount deposited by late Smt. Puttaveeramma as contended. Such representation shall be made within 15 days from the date of receipt of certified copy of this order.
