CORAM:
HON'BLE MR. JUSTICE SANJAY VASHISTH PRESENT: Mr. Rishu Mahajan, Advocate for the petitioner(s). Mr. Manjinder S. Bhullar, Addl. AG, Punjab. **** SANJAY VASHISTH, J. (Oral)
1. The instant second petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed here-under:- Name
of Petitioner(s) FIR No. Date Section(s) Police Station District Satbir Singh 148 11.06.2025 S. 21-C/29 of NDPS Act, 1985 Gate Hakima Amritsar
2. First regular bail petition filed by petitioner was dismissed as withdrawn at that stage vide order dated 26.02.2026 (Annexure P-5), because same was moved at an early stage. Though not much time has elapsed thereafter, instant second regular bail petition has been filed. However, keeping in view other attending circumstances highlighted by
learned counsel for petitioner, this Court is inclined to consider plea for grant of regular bail raised through instant second regular bail petition.

3. As per case of the prosecution, while police party was on patrolling in search of anti-social elements, two youths riding a Bullet motorcycle were noticed coming towards them. However, on seeing the police party, they tried to flee backward. When police party attempted to stop motorcycle, it fell on road, whereupon both occupants were apprehended. One of them disclosed his identity as Vikramjeet Singh @ Bika. A polythene bag was found in his hand and on its search, recovery of 912 grams of heroin was effected.
4.
Learned counsel for the petitioner argues that in the initial version of FIR, there is neither any allegation nor any evidence against the petitioner. Petitioner was taken in custody, subsequently, prosecution developed a case that petitioner – Satbir Singh, along with co-accused Vikramjeet Singh @ Bika, was indulging in illegal drug trafficking. Despite said allegations, no recovery was effected at instance of petitioner. To demonstrate false implication of the petitioner, learned counsel for the petitioner refers to the photographs appended with present petition as Annexure P-3 (six photographs), and then also refers to medical certificate dated 04.03.2025 (Annexure P-4), issued by the Amandeep Hospital (Amritsar) that on 29.11.2024, petitioner was beaten up by some miscreants, and thereon, he suffered several injuries. Injuries noticed are mentioned here-under:-
1. Fracture left ulna.
2. Fracture left tibia and medial malleolus.
3. Fracture left proximal phalanx 2nd and 3rd.
4. Compound right medial malleolus fracture, compound right great toe proximal phalanx fracture, and compound right ulna distal third fracture, compound 4th and 5th right metacarpal fracture.

5. Right hand – incised wound starting from dorsal of first webspace with running obliquely volar towards base of third matacarpal aspect size of wound is 14 CM X 3 CM X 3 CM, FDP of index & middle finger, FPL of thumb repair using modified Kesslers technique. 6. Forehead - a. Incised wound left side of forehead (Superficial) & size of wound is 7 CM X 2 CM X 1 CM. b. Incised wound at center part & upper part of forehead and size of wound is 4.5 CM X 1.5 CM.
5.
Learned counsel further submits that since the time of suffering of injuries, petitioner is almost incapable to move. Besides, no other criminal case stands registered against petitioner under NDPS Act, except one case under Section 307 of IPC (109 of BNS, 2023) along with a cross- version qua the same incident. In view of above, learned counsel for the petitioner submits that there is every likelihood of false implication in the present case, thus, seeks concession of regular bail to the petitioner. 6. On the other hand, learned State counsel, while opposing the prayer for bail, submits that from possession of main accused, with whom petitioner was allegedly travelling on motorcycle, a huge recovery of heroin was recovered, i.e., almost four times more than the maximum of non- commercial quantity. Therefore, keeping in view the nature of allegations and gravity of offence, petitioner does not deserve any leniency. Thus, seeks dismissal of bail petition. 7. I have heard learned counsel for the parties and perused the relevant material available on record. 8. Looking at photographs (Annexure P-3), which pertain to period of November, 2024, health condition of petitioner cannot be assessed JAWALA RAM 2026.07.06 11:49 I attest to the accuracy and authenticity of this document
CRM-M-32303-2026 - 4 - merely on basis thereof. However, making no comments on health condition of petitioner, and taking note of fact that nothing was recovered from petitioner, nor any specific role has been attributed to him in FIR, this Court is of prima facie view that allegations qua petitioner are required to be proved by prosecution by leading cogent and substantive evidence during course of trial. It is also noticeable that petitioner is inside jail for a period of more than 01 year and 18 days. Until aforesaid exercise is completed, personal liberty of petitioner need not be curtailed for any longer period. 9. In view of the aforementioned discussion, without commenting upon the merits of the case and taking into consideration the overall facts and circumstances, this Court deems it appropriate to grant concession of regular bail to the petitioner. Consequently, prayer made in the present petition is allowed. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case. 10.
Needless to observe that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly. 11. The observation made here-in-above shall not be construed as an expression of opinion on the facts of the case and the Trial Court is expected to decide the case on the basis of complete evidence available on record.
