JUSTICE RANJAN KUMAR JHA ORAL ORDER 2 20-07-2026 Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners seek anticipatory bail in connection with Babubarhi P.S. Case No. 484 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 109, 315(2), and 35 of the Bharatiya Nyaya Sanhita (BNS). 3. The case of the prosecution, in short, is that the informant namely, Dev Kumari Devi, filed a written complaint alleging that a dispute arose with the petitioners, who are her neighbors, over throwing garbage at her house. When the informant protested, petitioner no. 1, namely Ranjan Devi, allegedly grabbed her hair, pulled her down, and dragged her on Patna High Court CR. MISC. No.45623 of 2026(2) dt.20-07-2026 2/3 the road. It is further alleged that petitioner no. 2, namely Pankaj Kumar, assaulted her with an iron rod, due to which the informant became unconscious. 4. Learned counsel for the petitioners submits that both the parties are 'gotiyas' (agnates) having an ongoing land dispute and a counter-case bearing C.R. No. 831 of 2025 has also been filed. It is further submitted that petitioner no. 1 is a lady with minor allegations, and the petitioners bear clean antecedents. 5. Learned APP for the State opposes the prayer for anticipatory bail. 6. Considering the facts, since petitioner no. 1 is a lady with no allegation of causing serious injury, this Court is inclined to grant her anticipatory bail. Let petitioner no. 1 (Ranjan Devi), in the event of her arrest or surrender within four weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class, Madhubani. 7. So far as Petitioner No. 2 (Pankaj Kumar) is concerned, considering the specific allegation of assaulting the informant on the head with an iron rod, which finds support Patna High Court CR. MISC. No.45623 of 2026(2) dt.20-07-2026 3/3 from the injury report, this Court is not inclined to grant him anticipatory bail. 8.
