Also heard Mr. K. Baishya, learned Additional PP for the State. 2. In Sessions Case no. 39/2017, before the learned Session Judge, Dhemaji the applicant/appellant was convicted under section 354/448 IPC and sentenced to undergo rigorous imprisonment for 2 years and fine of Rs. 2000/-, (i/d, rigorous imprisonment for 1 (one) month) for conviction under section 354 IPC; (i/d, rigorous imprisonment for 6 months with fine of Rs. 500/-); (i/d, to undergo rigorous imprisonment for 15 days) for conviction under section 448 IPC. Sentences were directed to run concurrently. 3. Further, allowing the petition of the convict in this regard, he was allowed to remain on previous bail to enable him to prefer an appeal before this Court. It is submitted that the bail granted by the learned Convicting Court is till 17.03.2026 and by way of this interlocutory application, he seeks suspension of the sentence and to continue on bail. 4. The maximum sentence vide the impugned judgment is of 2 years. Moreover, the applicant/convict was on bail at the time of the judgment, which was extended to enable him to procure orders from this Court. 5. Accordingly, in the aforesaid facts and circumstances, the execution of Page No.# 3/3 the order of sentence dated 06.12.2025 passed by the learned Sessions Judge, Dhemaji in Sessions case no. 39/2017 shall remain suspended and the applicant/convict/appellant is hereby allowed to remain on previous bail till the disposal of the criminal appeal. 6.
