THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL REVISION CASE NO: 1165 of 2023
Judgment:
This Criminal Revision Case, under Sections 397 and 401 Cr.P.C./ Sections 438 r/w 442 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’),, has been filed by the petitioner/respondent challenging the order, dated 01.09.2023 passed in M.C.No.26 of 2020 by the learned Judge, Family Court-cum-VI Additional District and Sessions Judge, Kadapa.
2. Case of the petitioner is that the petitioner is husband of respondent No.1. The respondent No.1 filed a petition under Section 125 Cr.P.C., seeking to grant maintenance of Rs.29000/- per month from the petitioner herein and the learned trial Court after considering material and evidence on record, granted maintenance of Rs.15,000/- per month to the 1st respondent from the date of filing of the petition. Challenging the said
order, the petitioner/respondent preferred the present revision.
3. As could be seen from the impugned order, the petitioner herein is working as Junior Assistant in Z.P.Boys High School, Khajipeta and getting gross salary of Rs.69,827/- and after deductions, his net salary is Rs.51,572/- and in support of the same the respondent No.1 got marked Ex.A15 original salary certificate. The petitioner herein during his evidence in the cross- examination, he admitted the said fact. The learned trial Court after examining the facts and upon appreciation of the evidence on record, in a right
3
perspective granted maintenance as stated above and hence, this Court is not inclined to interfere with the order passed by the trial Court.
4. Accordingly, the Criminal Revision Case is dismissed.
As a sequel thereto, the miscellaneous petitions, if any, pending shall stand closed.
