The petitioner has filed the instant petition for following reliefs:- “10.1 This Hon’ble Court may kindly be pleased to directed the respondent State to call relevant records, pertaining to the instant matter. 10.2 Issue an appropriate writ, order or direction, particularly in the nature of Mandamus, directing the respondent authorities to consider and decide the petitioners’ representation/complaint (Annexure P/1) regarding removal of the encroachment made by the private respondents over the petitioners’ patta land bearing Khasra No. 266/7 and 266/1 situated at Village Raikheda, Tahsil Kharora, District Raipur, within a time- bound period. 3 10.3 Issue an appropriate writ, order or direction directing the respondent authorities to conduct a spot inspection and demarcation of the land bearing Khasra Nos. 266/7 and 266/1 through the competent Revenue Authorities and take appropriate action in accordance with law against the unauthorized encroachment made by the private respondents. 10.4 Issue an appropriate writ, order or direction directing the respondent authorities to remove the unauthorized encroachment and illegal construction, if any, raised by the private respondents upon the petitioners’ patta land and restore vacant possession thereof to the petitioners in accordance with law. 10.5 Issue an appropriate writ, order or direction directing the respondent authorities to ensure protection of the petitioners’ peaceful possession over the land bearing Khasra Nos. 266/7 and 266/1 and restrain the private respondents from interfering with the petitioners’ lawful possession except in accordance with law. 10.6 This Hon’ble Court may kindly be pleased to grant any other relief(s) deemed fit and proper in the facts and circumstances of the case, including costs of the petition.” 2. Learned counsel for the petitioners submits that the present petition has been filed seeking a limited relief. It is submitted that the petitioners have preferred a representation/complaint (Annexure P-1) before the competent authority seeking removal of the encroachment allegedly made by the private respondents over the petitioners' land held under patta/lease bearing Khasra Nos. 266/7 and 266/1, situated at Village Raikheda, Tahsil Kharora, District Raipur (C.G.). It is, therefore, prayed that the concerned Tahsildar be directed to consider and decide the said representation/complaint within a stipulated period. 3. Learned counsel for the State submits that if the prayer made by the petitioners is limited to the aforesaid extent, the State has no objection to the grant of such relief. 4 4. Heard learned counsel for the parties and perused the material available on record. 5. Considering the aforesaid facts and circumstances of the case, and having regard to the limited prayer made by the petitioners, this Court deems it appropriate to direct the concerned Tahsildar to consider and decide the petitioners' complaint in accordance with law, after affording due opportunity of hearing to the petitioners as well as respondents No. 5 to 11, and to pass an appropriate order within a period of 60 days from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the case, and the concerned Tahsildar shall decide the matter independently, strictly in accordance with law, uninfluenced by any observation made in this order. 6.
