IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) WEDNESDAY, THE TWENTY FIRST DAY OF JANUARY TWO THOUSAND AND TWENTY SIX PRESENT THE HONOURABLE SRI JUSTICE NINALA JAYASURYA WRIT PETITION No.30890 OF 2025 Between:
1. M/s. Swetha Purified Drinking Water, Nallagondrayanipalli Village, Rep. by Its proprietor, Golla Vijay Baskar, and another. ...Petitioners
AND
1. The State of Andhra Pradesh, rep. by its Principal Secretary, (Energy Department), Secretariat Buildings, Velagapudi, Guntur District, and others. ...Respondents Counsel for the Petitioners : Ms.S.Lakshmi Prameela Counsel for the Respondents: G.P. for Energy
Mr.Venkata Rama Rao Kota
G.P. for Revenue
Mr.P.Narasimhulu
The Court made the following ORDER:
Heard learned counsel for the petitioners. Also heard the learned Standing Counsel for A.P.S.P.D.C.L., and the learned counsel for the respondent No.7. 2. The writ petition is filed challenging the notice dated 17.10.2025. However, at the time of considering the matter, learned counsel for the petitioners submits that the petitioners are in fact challenging the notice dated 29.10.2025 (Ex.P.2) of the 5th respondent and inadvertently it is typed as 17.10.2025. Be that as it may. 2
3. The grievance of the petitioners in the present writ petition is that the respondent authorities are initiating action for disconnection of power supply to Service Connection No.7334329000200. 4. The learned counsel for the petitioners inter alia, submits that the petitioners are availing the power supply for running a purified drinking water plant and at the behest of some third parties, the proposed action was initiated. However, the submissions / contentions raised in the writ petition need not be examined in detail, in view of the counter affidavit filed on behalf of respondent Nos.2 to 5, wherein it is inter alia mentioned that pursuant to the notice dated 29.10.2025 calling upon the petitioners to produce documents on the proposed action of disconnection, the petitioners submitted an explanation dated 31.10.2025, which is filed as Ex.P.4. According to the learned counsel for the A.P.S.P.D.C.L., after considering the explanation of the petitioners to the said notice, the power supply was disconnected on 06.11.2025. However, as seen from the material filed along with the counter affidavit, no order pursuant to the explanation submitted by the petitioners was enclosed. The learned counsel representing the respondent Nos.2 to 5 states that no order appears to have been passed by the concerned authority. 5.
In the case on hand, admittedly to the notice dated 29.10.2025, the petitioners submitted their explanation (Ex.P.4). On receipt of the explanation, the respondent No.5 was required to pass reasoned order as to why the explanation submitted by the petitioners merits no acceptance. Surprisingly, without passing any order, the power supply to the Service Connection No.7334329000200 was disconnected on 06.11.2025 and the same is not tenable in Law. In the absence of any order, much less a reasoned order, the petitioners cannot be expected to work out their remedies effectively in Law. 3
6. In the aforesaid circumstances, as admittedly no order has been passed by the respondent No.5, this Court deems it appropriate to dispose of the writ petition, with a direction to the respondent No.5 to pass a reasoned order duly considering the explanation submitted by the petitioners, as expeditiously as possible, within a period of four (4) weeks from the date of receipt of a copy of this order. Before passing the orders, the respondent No.5 shall give an opportunity of hearing to the petitioners as also to the respondent No.7. Till appropriate orders, as indicated, are passed, the power supply to the Service Connection No.7334329000200 shall be restored. Needless to observe that if the petitioners fail to pay the electricity consumption charges, the authorities concerned are at liberty to disconnect the power supply, as per the procedure in vogue. 7. With the above directions, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ____________________ NINALA JAYASURYA,J Date: 21.1.2026. Note: Dispatch order copy in two (2) days. (By Order) vasu
