The petitioner is apprehending his arrest in connection with Bermo P.S. Case No.16 of 2023 for the alleged offences registered under Sections 467, 468, 471, 420, 120-B/34 of the IPC, pending in the Court of learned S.D.J.M., Bermo at Tenughat. 3. Learned counsel appearing for the petitioner submits that the supplementary affidavit is ready, however, the same could not be filed in the Registry. 4. In view of the aforesaid submission, the supplementary affidavit is taken on record. 5. Learned counsel appearing for the petitioner submits that only on the basis of suspicion of the mobile No.7368037358 as disclosed by the informant the petitioner is implicated in this case. He also submits that the petitioner has given the Aadhaar Card in the Pragya Centre and from the said centre the Aadhaar Card of the petitioner has been mis-utilized and the petitioner is alleged to have been utilizing the truck number of the petitioner in the said vehicle. He submits that the allegations are false and, on these grounds, he submits that anticipatory bail may kindly be granted. 6. Learned counsel appearing for the State opposed the prayer and submits that the informant namely Ritesh Roshan has stated that he is an owner of the 2026:JHHC:27508 Page | 2 A.B.A. No.4636 of 2026 said vehicle bearing Registration No.JH02AF-4514 and his driver namely Zamiruddin Ansari loaded coal into his truck from Karo Koiliayri, Thana Bermo, District – Bokaro, and when the vehicle was on the way on 07.08.2022 some unknown criminals made the truck driver hostage and looted the coal as well as the documents of the truck. It has been further stated that on 07.01.2023 a person named Om Prakash Tiwari who is the Transporter of Republic Career Transport, Kolkata gave his mobile no.9331501985 and 9830486325 and told him that someone has misused his truck or truck number in loading the scrap of iron from his company and stole it. However, the said vehicle was parked near the tyre shop near the DVC, Bermo Mines from 07.01.2023 to 08.01.2023. He has also stated that through the transporter Shreshta Road Lines, Patna he had come to know that unknown criminals embezzled iron scrap as well as white flour by attaching forged documents of his vehicle number JH02AF-4514. In this way, the crime was done and as such his anticipatory bail may kindly be rejected. 7. In the attending facts and circumstances of this case, I am not inclined to provide anticipatory bail to the petitioner. Accordingly, the present anticipatory bail application is hereby rejected.
