This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.07.13 11:32:53 +0530 2 arrested in connection with Crime No.154/2025 registered at Police Station Somani District Rajnandgaon C.G., for the offence punishable under Sections 20(B) & 29 of N.D.P.S. Act. 2. Case of the prosecution, in brief, is that on 21.07.2025, acting on secret information, the police intercepted vehicle No. WB23E/4218 and recovered 215 kg of ganja from the possession of co-accused Bharat Kumar Singh and Puran Lal Ladia @ Raju. Accordingly, Crime No. 154/2025 was registered at Police Station Somani, District Rajnandgaon, under Section 20(b) of the NDPS Act. During investigation, the co-accused disclosed that one Imran, using mobile No. 9343937859, was to inform them about the delivery of the contraband at Jalna, Maharashtra. The said mobile number was found to be registered in the name of the present applicant, who was thereafter arrested and charge-sheeted. 3. Learned counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in the present case. It is contended that no contraband was recovered from the possession of the applicant and his implication is solely based on a mobile SIM registered in his name, which, according to the applicant, had been given to one Imran Memon for use. It is further submitted that there is no direct 3 evidence connecting the applicant with the seized contraband. He would submit that the charge sheet has been filed in this case, the applicant is in jail since 31/03/2026 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. Learned counsel appearing for the State/respondent would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court. He would submit that the mobile number used for coordinating the transportation and delivery of 215 kg of ganja which was recovered from the co-accused persons, was registered in the name of the applicant and the said contraband article which was recovered is above the commercial quantity, as such, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the nature and gravity of the allegations, the recovery of contraband article i.e. 215 kg of ganja from the co-accused persons, which is above the commercial quantity and further the fact that the mobile number allegedly used for coordinating the transportation and delivery of the said contraband was registered in the name of the applicant, therefore, this Court is of the 4 opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant Pawan Ratre Urf Imran, involved in Crime No.154/2025 registered at Police Station Somani District Rajnandgaon (C.G.), for the offence punishable under Sections 20(B) & 29 of N.D.P.S.
