The Court made the following:
3
ORDER:
The Writ Petition is filed aggrieved by the action of the respondents in not digitally signing the revenue records like, Adangal/ Pahani and RoR 1B register of the petitioner’s land admeasuring an extent of Ac.0.26 cents in R.S.No.58/1A and Ac.1.30 cents in R.S.No.56F of Konanki Village, Marturu Mandal, Bapatla District, and prayed to direct the 4th respondent-Tahsildar to digitally sign the revenue records such as, Adangal/Pahani and RoR 1B for the aforesaid subject land.
2. It is stated in the affidavit filed in support of the Writ Petition that the above said subject property belongs to one Kalluri Seethaiah, S/o.Veeraiah, who is grandfather of the petitioner herein and Kalluri Seethaiah executed a registered gift deed in favour of the petitioner, vide document No.3563/2001 dated 07.11.2001 in the office of SRO, Marturu, since then, the petitioner is in possession and enjoyment of the said land.
3. Nevertheless, one Gorantla Hanumantha Rao, who is no way connected with the subject land of the Writ Petition filed an appeal before the Revenue Divisional Officer, Ongole, to mutate his name in
4
the revenue records and the said appeal was dismissed by the R.D.O., vide proceedings in D.Dis.c/515/2013 dated 24.07.2014.
4. Aggrieved by the order of the 3rd respondent-Revenue Divisional Officer, one Gorantla Hanumantha Rao, an unconnected person by name Kalluri Indira, filed a Revision under Section 9 of the A.P.Rights in Land and Pattadar Pass Books Act, 1971, before the Joint Collector and Additional District Magistrate, Prakasam District, Ongole, and the said Revision is dismissed by the Joint Collector and Additional District Magistrate, vide order dated 23.06.2018, confirming the orders of the 3rd respondent-Revenue Divisional Officer. Notwithstanding the said proceedings, the 4th respondent has not digitally signed the revenue records. Therefore, the petitioner seeks a direction from this Court as stated above.
5. The 4th respondent-Tahsildar has filed counter affidavit and stated that the subject land in Sy.Nos.56E and 56F of Konanki Village was kept under Dispute Register as per the orders of the Joint Collector, Ongole, due to an ongoing dispute regarding the title of the land. The Tahsildar's digital signature will only be affixed after the Principal Junior
5
Civil Judge Court, Addanki, resolves the title issue in O.S.No.36 of 2010, which involves a dispute between the petitioner and others.
6.
Learned counsel for the petitioner argues that the revenue record clearly demonstrates that the petitioner is the owner of the subject land and the writ petitioner is not party to the suit pending on the file of Principal Junior Civil Judge Court, Addanki in O.S.No.36 of 2010 and prays to direct the respondents to provide digital signature on the revenue records, such as, Adangal/Pahani and RoR 1B for the aforesaid subject land.
7. Additionally, learned counsel for the petitioner argues that the respondents have not recorded the name of the petitioner for unwarranted reasons. Hence, prays to direct the respondents to digitally sign on the revenue record, such as, Adangal/Pahani and RoR 1B for the aforesaid subject land.
8. The revenue record indicates the petitioner’s name and the appeal and revision were concluded in favour of the writ petitioner. It is asserted in the reply affidavit that the petitioner is indeed not a party to the suit, contradicting the claim in the counter affidavit that a title dispute exists.
6
9. Therefore, the present Writ Petition is disposed of, directing the respondents/authorities to take appropriate action in accordance with the relief sought in the Writ Petition, in accordance with law. There shall be no order as to costs.
As a sequel thereto, Interlocutory Applications pending, if any, shall stand closed.
