NATARAJ - 7 - HC-KAR NC: 2026:KHC:28877 WP No. 7013 of 2026 C/W WP No. 6916 of 2026 WP No. 6923 of 2026 AND 1 OTHER ORAL ORDER The petitioners have sought for a writ in the nature of mandamus to direct the respondents to consider and dispose of their representations dated 20.06.2025 and comply the terms of the joint memos dated 02.05.2025 and 23.04.2025 respectively, filed in Ex.P. No.52/2025, Ex.P.No.178/2022, Ex.P.No.49/2025 and Ex.P.No.54/2025 and to deposit the compensation amount of Rs.64,93,387/-, Rs.1,79,11,890/-, Rs.25,23.331/- and Rs.48,39,226/- along with all statutory benefits and applicable interest, before the concerned Court. 2. (i) The petitioners in all these petitions contend that their lands situate in various survey numbers in Tumakuru Taluk and District were acquired for the purpose of formation of the Hemavathi Canal. An award was passed and being aggrieved by the quantum of compensation determined, the petitioners sought references under Section 18 of the Land Acquisition Act, 1894. Accordingly, references were registered in LAC No.113/1997, LAC No.13/2018 and LAC No.110/1998 and LAC No.16/1997 and the reference Court enhanced the compensation. Being aggrieved by the said awards, the - 8 - HC-KAR NC: 2026:KHC:28877 WP No. 7013 of 2026 C/W WP No. 6916 of 2026 WP No. 6923 of 2026 AND 1 OTHER petitioners preferred appeals, which were allowed and the compensation was enhanced. (ii) The petitioners contend that they initiated proceedings to execute the judgments and awards passed by the Appellate Court in Ex.P.No.52/2025, Ex.P.No.178/2022, Ex.P.No.49/2025 and Ex.P.No.54/2025. In the said petitions, respondent No.4 in W.P.No.7041/2026, 7013/2026, 6916/2026 and respondent No.2 in W.P.No.6923/2026 entered into settlements, in terms of which, the respondent No.1 agreed to deposit the compensation determined by the Appellate Court. Accordingly, the execution petitions were disposed off by orders dated 02.05.2025 and 23.04.2025 respectively. (iii) The petitioners in all these petitions contend that as per the joint memos, the respondents agreed to deposit the agreed compensation within three months from the date of receipt of the orders passed in Ex.P.No.52/2025, Ex.P.No.178/2022, Ex.P.No.49/2025 and Ex.P.No.54/2025. However, the respondents have failed to do so. The petitioners therefore, submitted representations dated 20.06.2025 requesting respondent No.1 to deposit the compensation in - 9 - HC-KAR NC: 2026:KHC:28877 WP No. 7013 of 2026 C/W WP No. 6916 of 2026 WP No. 6923 of 2026 AND 1 OTHER terms of the joint memos filed in the execution petitions. The petitioners contend that the said representations are not considered and therefore, pray that a direction be issued to respondent No.1 to consider the representations and deposit the compensation as agreed in execution petitions. 3. Learned counsel appearing for the petitioners in all these petitions reiterated the above contentions and prays that a direction be issued to the respondents to consider the representations of the petitioners. 4. Learned Additional Government Advocate for respondent No.1 and learned counsel appearing for other respondents submit that the respondents have already paid portion of the compensation to the petitioners and therefore, there is no need to issue any direction. 5. A perusal of the writ petitions show that a settlement was arrived at between the petitioners and respondents, in terms of which, respondent No.1 agreed to deposit the respective compensation along with all statutory benefits and applicable interest. - 10 - HC-KAR NC: 2026:KHC:28877 WP No. 7013 of 2026 C/W WP No. 6916 of 2026 WP No. 6923 of 2026 AND 1 OTHER 6. The settlement was drawn on 02.05.2025 and 23.04.2025 and as per the settlement, the respondents were bound to deposit the compensation within three months from the date of the orders passed in the execution petitions. Since the same has not been done and as the respondents are under a public duty to honour the settlement arrived at before the Executing Court, a direction deserves to be issued to the respondents to deposit the compensation as agreed in execution petitions. 7. This shall be complied within a period of two months from the date of receipt of a copy of this order, failing which interest @ 9% per annum shall be paid on the balance amount from the date of expiry of two months from the date of receipt of a copy of this order till payment and the interest so paid shall be recovered from the person/s responsible for the delay in payment.
