1. This is the first bail application filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 151/2025 registered at Police Station Bodla, District Kabirdham (C.G.) for the offence punishable under Section 20(b) of the Narcotics Drugs and Psychotropic Substance Act, 1985.

The prosecution's case, in brief, is that on 07.10.2025 a secret information was received from an informant by the concerned police that one Silver Colour swift Dzire bearing Registration No.CG-04-LT- 5931 is carrying Ganja and is going from Raipur to Jabalpur Odisha to DEEPTI JHA Digitally signed by DEEPTI JHA
2 Kondagaon. Upon trapping the said car was stopped and on search 54 packet in total 57.810 KG Ganja was seized from the joint possession of the present applicant and other co-accused. Based on above facts, a crime was registered against the present applicant. Hence, the bail application.

Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that there is no direct evidence available on record to show that the applicant in involved in the said crime. It is further submitted that investigating officer has not complied with the mandatory provisions. He also submits that there is no criminal antecedents registered against the present applicant, the charge sheet has been submitted in this case and he is in jail since 07.10.2025, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail.
4. On the other hand, learned State counsel opposes the bail application and submits that applicant has no criminal antecedent.
5. I have heard learned counsel for the parties and perused the material available on record.

Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that total 57.810 KG quantity of contraband article Ganja has been seized from the joint possession of the present applicant and other co- accused person, which more than commercial quantity, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.

7. Accordingly, this first bail application of applicant – Mohsin Khan involved in Crime No. 151/2025 registered at Police Station Bodla, District Kabirdham (C.G.) for the offence punishable under Section 20(b) of the Narcotics Drugs and Psychotropic Substance Act, 1985, is rejected at this stage.
8. Needless to say that the learned trial Court concerned is at liberty to proceed with the trial and conclude the same, expeditiously.
