JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.2 in Crime No.94/2026 registered by Chamarajpet Police Station, Bengaluru City for the offence punishable under Section 22(C) of NDPS Act, 1985, is before this Court in this petition filed under Section 483 of BNSS 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.94/2026 was registered by Chamarajpet Police Station, Bengaluru City for the aforesaid offence initially against one Aravind, based on the first information dated 23.02.2026 received from Avinash H.B., Police Officer attached to Chamarajpet Police Station, Bengaluru City. In the said case, accused Nos.2 and 3 were arrested on 23.02.2026 and remanded to judicial custody. Bail application filed by accused No.2 - 3 - HC-KAR NC: 2026:KHC:33180 CRL.P No. 6183 of 2026 before the jurisdictional Sessions Court in Crl.Misc.No.2353/2026 was rejected on 04.04.2026. Therefore, he is before this Court. 4. Learned counsel for the petitioner submits that the alleged recovery of the contraband article from the possession of accused Nos.2 and 3 is a joint recovery. Considering the same, the Co-ordinate Bench of this Court has granted regular bail to accused No.3 in Crl.P.No.4745/2026. The petitioner has no other similar criminal antecedents. Accordingly, prays to allow the petition on the ground of parity. 5. Per contra, learned HCGP who has opposed the petition does not dispute the submission made by the learned counsel for the petitioner. 6. FIR in the present case was registered initially against accused No.1. It appears that based on the confession statement of accused No.1, subsequently, accused Nos.2 and 3 were arrested and from their - 4 - HC-KAR NC: 2026:KHC:33180 CRL.P No. 6183 of 2026 possession contraband article allegedly MDMA weighing 25 grams, 04 grams of methamphetamine and 01 gram of premonish was recovered and seized under a panchanama. 7. Accused No.3 had approached this Court in Crl.P.No.4745/2026, which was allowed on 22.04.2026. In paragraph No.6 of the order passed in Crl.P.No.4745/2026, the Co-ordinate Bench of this Court has observed as follows: "6. Having heard learned counsel for the respective parties and on perusal of the submissions of the learned counsel for the respective parties, it appears that the petitioner has been apprehended at the instance of the accused No.1. Though, it is alleged that 25 grams of contraband has been seized from the accused Nos.2 and 3, the fact remains that it is a joint recovery. Having considered the said aspect, it is appropriate to grant him bail by imposing suitable conditions. Under the circumstances, the petitioner is entitled for grant of regular bail on the ground of parity. Accordingly, the following: O R D E R The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.94/2026 registered by Chamarajpet Police Station, Bengaluru City for the offence punishable under Section 22(C) of NDPS Act, 1985, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 6 - HC-KAR NC: 2026:KHC:33180 CRL.P No. 6183 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. f) The petitioner shall appear before the Station House Officer (S.H.O) of Chamarajpet Police Station on every first and third Sunday of the month between 10.00 a.m. and 1.00 p.m. and mark his attendance till the investigation of the case is completed and charge sheet is filed.
