This is the 1st bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the Applicant who has been arrested in connection with Crime No. 24/2026 registered at Police Station – Bagbahra, District: Mahasamund (C.G.), for the offences under Section 20 (b) (ii) (c) and Section 29 of NDPS Act. Brief facts of the case are that 9 February 2026, at about 6:20 A.M., ASI Akhil Sahu of Police Station Bagbahra received confidential information that two persons were transporting Ganja from Odisha to Bagbahra in a white Hyundai Verna (Registration No. MP-07-AG-8311). After informing his superior officers and completing the required legal formalities, the police, along with two independent witnesses, laid a trap near the Janpad Panchayat Office on NH-353. The vehicle was intercepted after approximately 30–45 minutes. The occupants were identified as Sumit Srivastava and Smt. Reena Bhadoriya, both residents of Madhya Pradesh. They were informed of their rights under Section 50 of the NDPS Act and consented to be searched by the police. During the search, the police recovered two plastic bags containing a total of 40 kilograms of Ganja concealed in the car's boot. The contraband, valued at approximately ₹20 lakh, along with the Hyundai Verna and two mobile phones, was seized. The accused failed to produce any valid authorization for transporting the narcotic substance and allegedly admitted that they had procured it from Odisha for sale in Madhya Pradesh. Both accused were arrested on 9 February 2026 under Section 20(b) of the NDPS Act. Based on the aforesaid allegations, the police registered the offences as mentioned 3 above against the present Applicant. Hence, this application. 3. Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case and she is in incarceration since 09.02.2026. It is argued that no contraband has been seized from the exclusive possession of the Applicant. He further submits that mandatory compliance of Section 50 of the NDPS Act and Section 42 of NDPS Act has not been complied with and the conclusion of trial is likely to take considerable time, therefore, it is prayed that he may be enlarged on regular bail. 4. On the other hand, learned Counsel for the State opposes the bail application and submits that charge-sheet has been filed before the Competent Court. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the submissions advanced by learned Counsel for the parties, the nature of allegations levelled against the applicant and that the quantity of seized contraband is 40 kg which is a commercial quantity and considering the nature and gravity of the offence, the allegations regarding the applicant's involvement in the crime in question, charge-sheet has been filed, without further commenting anything on the merits of the case, this Court is of the considered opinion that 4 it is not a fit case to allow the application. 7. Accordingly, the bail application of the applicant – Smt. Reena Bhadoriya involved in Crime No. 24/2026 registered at Police Station – Bagbahra, District: Mahasamund (C.G.), for the offences under Section 20 (b) (ii) (c) and Section 29 of NDPS Act is hereby rejected. 8.
