Heard the learned counsel appearing for the respective parties.
The petitioner is an accused in connection with S.T. No. 200 of 2024 arising out of Balumath P.S. Case No. 69 of 2024, pending in the Court of learned Additional Sessions Judge-II, Latehar.
The prayer for bail of the petitioner was earlier rejected in B.A. No. 10055 of 2024.
Submission has been advanced by the learned senior counsel for the petitioner that there has been an inordinate delay of 7 days in instituting the First Information Report. It has been submitted that no explanation has been furnished by the informant. Learned senior counsel submits that out of 7 charge sheet witnesses, 4 witnesses have been examined by the prosecution and all have been declared hostile by the prosecution. He adds that the petitioner is in custody since 13.06.2024.
Learned A.P.P. has opposed the prayer for bail of the petitioner.
The petitioner is alleged to have entered into the house of the informant and committed rape upon her. The victim is yet to be examined.
Regard being had to the nature of allegations levelled against the petitioner, I am not inclined to grant bail to the petitioner. The same is hereby rejected at this stage.
