The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 13/2026, registered at Police outpost Mopka, P.S. Sarkanda, Bilaspur (C.G.) for alleged commission of offence punishable under Sections 119 (1), 296, 115 (2), 351 (2) & 3 (5) of the Bhartiya Nyaya Sanhita, 2023
2. Case of the prosecution, in brief, is that on 04.01.2026 complainant Yogesh Dewangan lodged written report at Police Station Sarkanda
2 alleging that in the evening of 04.01.2026, at about 6 pm while he was at home, Anurag Chandra & Rohit Patel asked him to come near Mopka square. When he reached there, at about 6.30 pm. Anurag Chandra and his associates demanded money from the complainant for purchasing liquor. Upon his denial for the same, they abused him in filthy language in the name of his mother and sister and threatened him to death and also assaulted him with hand & fist, as a result thereof, he sustained injuries. Based on above complaint lodged by the complainant, FIR has been registered against the applicant and other co-accused persons for the aforesaid offences.

Learned Counsel appearing for the applicant submits that the applicant has been falsely implicated in the instant case, as there is no evidence available on record to connect the applicant with the crime in question. He submits that the complainant Yogesh Dewangan himself appeared before the trial Court and filed an application stating that he has no objection to grant of bail to applicant – Anurag Chandra and that the applicant was not involved in the incident, despite that the trial Court has rejected the bail application filed by the applicant. It is submitted that FIR was lodged under the influence of anger / enmity and the complainant himself has admitted before the trial Court that the applicant was known to him as a friend/acquaintance, which lends credence to the possibility of false implication. As such, the applicant may be extended the benefit of anticipatory bail.
4. On the other hand, counsel for the State submits that the applicant is said to have intercepted two persons and demanded money for liquor and when they refused for the same, the applicant along with other co-
3 accused persons assaulted the complainant by hand & fist, as a result thereof he suffered injuries and, therefore, the applicant is not entitled for anticipatory bail.
5. I have heard learned counsel for the parties and perused the material available on record.
6. Having heard learned counsel for the parties, having regard to the facts & circumstances of the case and considering the nature and gravity of the offence and and taking into account the allegations leveled against the applicant, I am not inclined anticipatory bail to the applicant.

Accordingly, the Anticipatory Bail application of the applicant – Anurag Chandra, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 13/2026, registered at Police outpost Mopka, P.S. Sarkanda, Bilaspur (C.G.) for alleged commission of offence punishable under Sections 119 (1), 296, 115 (2), 351 (2) & 3 (5) of the Bhartiya Nyaya Sanhita, 2023 is hereby rejected.
