1. This first anticipatory bail application under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.29/2026 registered at Police Station – Excise Circle Dantewada, District Dantewada (C.G.) for the offence punishable under Sections 34 (1) (a), 34 (2) & 36 of the Excise Act. At the outset, learned State Counsel raises a preliminary objection regarding the maintainability of the present Anticipatory bail application, as the same is not maintainable in view of the provisions contained in Section 59-A of the CG Excise Act and submits that the present Anticipatory bail application may be rejected on this ground alone.

In view of the submission made by learned State Counsel, the present Anticipatory bail application preferred by the Applicant – Tinku Dutta, filed under Section 482 of the BNSS, 2023 for grant of anticipatory bail apprehending his arrest in connection with Crime No.29/2026, registered at Police Station Excise Circle Dantewada, District Dantewada for offence punishable under Sections 34 (1)(a), 34 (2) and 36 of the Excise Act, is dismissed, as not maintainable in view of Section 59-A of the Chhattisgarh Excise Act.
