This revisional application has been filed praying for expeditious disposal of an application under Order XII Rule 6 of the Code of Civil Procedure, 1908 as well as the partition suit being Title Suit No. 1273 of 2023. 2. Learned Advocate appearing for the petitioner submits that an application under Order XII Rule 6 of the Code had been filed before the learned Trial Court on September 22, 2025 but the same has not yet been disposed of and is kept pending. It is submitted that the opposite party has been taken time since the filing of the said application. It is further submitted by the learned Advocate for the petitioner that submissions on the part of the petitioner got concluded on January 21, 2026 and the case was fixed for hearing the arguments on behalf of the opposite party. 3. In view of the nature of the order proposed to be passed by this Court, direction for prior service of notice along with a copy of the revisional application 2 on the opposite party is not being made, however, the petitioner shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite party within a week from date. 4. Having heard the learned Advocate appearing for the petitioner and having perused the material- on-record, this revisional application is disposed of by requesting the learned Trial Court to dispose of the petitioner’s application under Order XII Rule 6 of the Code as expeditiously as possible and preferably within two months from the next date fixed. 5. The learned Trial Court is also requested to dispose of the suit as expeditiously as the business of the Court would permit. 6. C.O. 786 of 2026 stands disposed of. No costs. 7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
