SPL.PUBLIC PROSECUTOR FOR CID The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction more particularly one in nature of Writ of Mandamus, declaring the action on the part of Respondents 2 to 4 under the guise of investigation in freezing Petitioners entire Savings Account No.50100470670576, Loan Account bearing No.158042333, Fixed Deposits bearing No.50301199583724 without quantifying the amount and period with allegation that Petitioners Savings Bank Account has got suspicious transaction to the tune of an amount of Rs.l4, 400-00 as illegal, arbitrary, against principles of natural justice and consequently direct the Respondents 2 to 4 to defreeze Petitioners entire Savings Account No.50100470670576, Loan Account bearing No.158042333,Fixed Deposits bearing No.50301199583724 by keeping a lien over sum of Rs.l4, 400-00 the alleged suspicious amount and pass….” 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for CID/ respondent No.2. 3. No representation for respondent No.4/H.D.F.C. Bank, in spite of notice served on it. 4. Sri N. Chandra Sekhar Reddy, learned counsel for the petitioner, submits that Under the guise of a suspicious amount credited into the 3 Dr. YLR, J W.P.No.30449 of 2025 Dated 06.03.2026 account to the tune of Rs.14,400/-, the entire bank account of the petitioner was frozen. 5. Learned Assistant Public Prosecutor, submits that The CID has not issued any directions to the H.D.F.C. Bank. It was only communicated by the Cyber Crime Coordination Center, which, if required, had directed respondent No.4 to hold the amount pending further instructions from the authorities. 6. Admittedly, the suspicious amount is Rs.14,400/-. The respondent No.4 has no authority to freeze the petitioner’s entire savings account bearing No. 50100470670576, loan account bearing No. 158042333, and fixed deposit account bearing No. 50301199583724 without quantifying the amount and specifying the period. The H.D.F.C. Bank/respondent No.4 has acted over smart, thereby causing considerable inconvenience to the petitioner/customer. 7. In view of the facts and circumstances of the case, the writ petition is allowed with costs, declaring the action of respondent No.4 in freezing the petitioner’s entire savings account bearing No. 50100470670576, loan account bearing No. 158042333, and fixed deposit account bearing No. 50301199583724, without quantifying the amount, to be unsustainable. Of course, there is justification on the part of respondent No.4 in freezing or placing a lien over the amount of Rs.14,400/-. The respondent No.4 is 4 Dr. YLR, J W.P.No.30449 of 2025 Dated 06.03.2026 directed to defreeze the savings account bearing No. 50100470670576, loan account bearing No. 158042333, and fixed deposit account bearing No. 50301199583724; however, the lien over the suspicious transaction amount of Rs.14,400/- shall continue.
