Adhar Card No. 9825,6883,7926 --- Applicant versus • State Of Chhattisgarh Through- Station House Officer S.H.O. P.S. Khairagarh District Khairagarh Chuikhadan Gandai C.G. --- Non-applicant (Cause title taken from Case Information System) For Applicant : Mr. Devershi Thakur, Advocate. For State/Non-applicant : Mr. Soumya Rai, Deputy G.A. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 09.07.2026 1. This first anticipatory bail application filed under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.528/2025 registered at Police Station Khairagarh, District Khairagarh – Chuikhadan – Gandai (C.G.) for the offence punishable under Section 318(4) of B.N.S., 2023. 2. The prosecution's case, in brief, is that a written complaint was lodged by the Branch Manager of Bharat Financial Inclusion Limited, Branch DEEPTI JHA Digitally signed by DEEPTI JHA 2 Ganjipara, Khairagarh, alleging that the applicant, Ankush Gadhpayle, who was working as a Sangam Manager in the company for about 9 months, was entrusted with the work of visiting villages, disbursing loans to members associated with the Khairagarh branch and collecting loan installments from them for deposit in the office. It is alleged that the applicant collected installments and outstanding loan amounts from about 48 local customers of the Khairagarh branch, but did not deposit the same in the office and, instead, kept the amounts with himself, though receipts for installments were issued to the customers. The applicant has misappropriated a total sum of 24,17,778/- from 48 customers, of which 2,70,795/- is stated to be still outstanding. Based ₹ on such complaint, present case has been registered against the present applicant. 3. Learned counsel for the applicant would submit that the applicant is innocent and he has been falsely implicated in crime in question on account of dispute, regarding accounts and recovery, essentially arising out of an employer-employee relationship. He further submits that FIR has been lodged on 21.11.2025, after a huge delay, which is also unexplained and it is only version of Branch Manager of the company. It is further submitted that applicant was relieved from service in the month of September, 2024 whereas alleged transactions have taken place thereafter and all the evidences are based on oral testimony and documents, which are already in possession of the police, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel for the non-applicant/State, would opposes the bail application of the applicant and submits that bail application of the applicant is rejected by the Upper Sessions 3 Judge, Khairagarh, District Khairagarh – Chuikhadan – Gandai (C.G.), therefore, the applicant may not be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case and further considering the fact that FIR has been lodged belatedly, which is also unexplained and further considering the fact that the evidence & documents are in the possession of the concerned police station and also the fact that charge has not been filed, therefore, without commenting anything on merits, I am inclined to grant anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Ankush Gadhpayle, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such fact to the Court.
