1. The petitioner has approached this Court feeling aggrieved of
order dated 18th July, 2026 passed by the court of Special Judge (NDPS), Baramulla, in case titled “Abdul Rashid Dar vs Narcotics Control Bureau (NCB) Through Sub Inspector Zonal Unit Srinagar”, wherein the learned Trial Court while granting extension of bail, had specifically stipulated in Para 8 (e) that the petitioner shall surrender before the Superintendent, District Jail, Baramulla immediately upon expiry of the extended period of interim medical bail on 8th August, 2026, without any further extension application.
2. In fact, the restriction imposed by the learned Trial Court upon the petitioner to move further application for extension of bail, is the cause of grievance involved in the present petition.
3. Since an innocuous prayer is made by the learned counsel for the petitioner, this petition is disposed of at this stage by providing that
the petitioner shall be at liberty to move an application before the Trial Court if medical condition so demands and in case any such application is moved, the learned Trial Court shall deal with the same on its merits, after drawing due satisfaction.
4. Petition is accordingly disposed of on the above terms.
