Tiwari, PP HON'BLE MR. JUSTICE SAMEER JAIN Order 16/03/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 119/2025 registered at Police Station Bagar District Jhunjhunu for the offence(s) under Sections 115(2), 126(2), 307 & 351(2) of BNS, 2023. 2. Learned counsel for the accused-applicant has submitted that the applicant is a young person, aged about 20 years. It is submitted that there exist only single criminal antecedent registered against the applicant. It is further submitted that the co-accused persons, namely Nitish @ Nitesh, Sandeep Kumar @ Dang & Ajay Jakhar, despite of having more criminal antecedents than the present applicant, have been enlarged on bail by the Co- ordinate Bench of this Court vide order dated 11.02.2026 passed in S.B. Criminal Miscellaneous Bail Application [2026:RJ-JP:11033] (2 of 2) [CRLMB-2963/2026] No.2419/2026, order dated 31.01.2026 in S.B. Criminal Miscellaneous Bail Application No.1880/2026 & order dated 22.01.2026 in S.B. Criminal Miscellaneous Bail Application No.17090/2025. 3. Per contra, learned Public Prosecutor has vehemently opposed the instant bail application. 4. Having heard the arguments advanced by learned counsel for the parties, taking note of the fact that the applicant is a young person, aged about 20 years; that there exist only single criminal antecedent registered against the applicant; that the co- accused persons have already been enlarged on bail, and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused- applicant and enlarge him on bail. 5. Accordingly, the second bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Rahul @ Kalu S/o Suresh shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
