Petitioners, who are apprehending arrest in Crime No.10/2026 registered by Devaraja Police Station, Mysuru, for offences punishable under Sections 316(2), 318(4) and 61(2) of Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as 'BNS, 2023' for short), are before this Court in this criminal petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking anticipatory bail. 2. Heard learned counsel appearing for the petitioners and learned Addl. SPP appearing for the respondent-State. 3. FIR in Crime No.10/2026 was registered by Devaraja Police Station, Mysuru, against the petitioners for the aforesaid offences based on the first information dated 26.01.2026 received from Mr.S.Suresh Kannan, Authorized Representative, Tamilnad Mercantile Bank Ltd., Mysuru Branch. Apprehending arrest in the said case, petitioners herein, who are brothers, had filed - 3 - HC-KAR NC: 2026:KHC:33579 CRL.P No. 7045 of 2026 Crl.Misc.No.402/2026 before the Jurisdictional Sessions Court, which was rejected on 18.03.2026. Therefore, the petitioners are before this Court. 4. First information was submitted by the Authorized Representative and Manager of the Tamilnad Mercantile Bank Ltd. Accused No.1 is the Authorized Jewel appraiser of the Bank and Accused Nos.2 to 7 had pledged fake jewelry based on the certificate issued by accused No.1 and had availed loan from the bank and thereby, cheated the bank. Allegation as against the petitioners, who hail from Chitradurga District, is that they had prepared fake jewelry, which were pledged in the bank. 5. There is no material available on record to show that the petitioners had knowledge that the fake jewelry purchased from their shop were supposed to be pledged in a bank for the purpose of availing loan. It appears that even earlier, a similar case was registered against the petitioners and in the said case, they have been granted bail. - 4 - HC-KAR NC: 2026:KHC:33579 CRL.P No. 7045 of 2026 6. It is brought to the notice of this Court that accused Nos.3, 4, 5, 7, 10 and 11 have been granted bail. Petitioners have undertaken to cooperate with the Police for the purpose of investigation. Alleged offences are triable by the Court of Jurisdictional Magistrate and maximum punishment for the alleged offence is imprisonment for a period of seven years. 7. Under the circumstances, I am of the opinion that the prayer made by the petitioners for anticipatory bail needs to be answered affirmatively subject to imposing appropriate conditions. Accordingly, the following order: ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.10/2026 registered by Devaraja Police Station, Mysuru, for offences punishable under Sections 316(2), 318(4) and 61(2) of - 5 - HC-KAR NC: 2026:KHC:33579 CRL.P No. 7045 of 2026 Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: 1. Each of the petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witness and they shall co-operate with the police for investigation and appear before them whenever called upon. 4.
