This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.45/2026 registered at Police Station Pamgarh, District Janjgir- Champa (C.G.) for the offence punishable under Sections 309(6), GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.07.11 18:09:33 +0530 2 310(2), 111 (2) (b) of B.N.S. 2. Case of the prosecution, in brief, is that on 27.01.2026, the complainant was intercepted by four unknown persons near Madhukar Petrol Pump, Village Cheoudih, who allegedly assaulted him, robbed him of Rs.10,000/- and a mobile phone, and caused injuries. On the basis of the complaint, Crime No. 45/2026 was registered at Police Station Pamgarh for the relevant offences. During investigation, the present applicant was arrested on 06.02.2026 on the basis of the memorandum of a co-accused recorded in Crime No.44/2026. After completion of investigation, a charge-sheet was filed against the applicant and other accused persons for the offences alleged. 3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. He would submit that name of the applicant has come into light in the memorandum statement of co-accused. He would submit that total five cases have been registered against the applicant on the basis of one memorandum and all of them are listed today. He would submit that the charge sheet has been filed in this case, the applicant is in jail since 06/02/2026 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application. He would submit that the manner in which the incident has taken place, the applicant along with 9 other accused persons attacked the passers by and looted them, hence committed dacoity with them. He would submit that so far as the applicant is concerned, iron rod and Rs.1000/- has been recovered from him. He would submit that considering the 3 nature and gravity of allegation, applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the nature and gravity of the allegations and the applicant's alleged participation in the commission of dacoity along with other co-accused, therefore this Court is of the opinion that this is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Shani Ram Gond involved in Crime No.45/2026 registered at Police Station Pamgarh, District Janjgir-Champa (C.G.) for the offence punishable under Sections 309(6), 310(2), 111 (2) (b) of B.N.S., is rejected. 8.
