THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM CIVIL MISCELLANEOUS APPEAL NO: 1289/2008
JUDGMENT: (per Hon’ble Sri Justice Ravi Nath Tilhari)
The respondent-husband filed O.P.No.80 of 2006 seeking divorce under Section 10(ix) of the Indian Divorce Act for dissolution of marriage with the present appellant. The same was allowed on 28.01.2008 by the Principal Senior Civil Judge, Kakinada. The wife-appellant has filed the present appeal.
2. The matter was referred to the mediation centre of this Court by an
order dated 17.09.2025. By the same order it was also provided that the mediation centre shall also sent the notice to the parties. Initially interim report dated 04.11.2025 was received seeking extension of time on the ground that the parties were informed the date fixed by the mediator but on the date fixed, only the respondent-husband was present and petitioner-wife was absent. Time was extended by an order dated 13.11.2025. The final report dated 07.01.2026 has been received intimating that the matter was not settled. As per the report, the matter was not settled because inspite of service, the respondent appeared but the wife-appellant did not appear.
3. On 30.01.2025, 23.07.2025 and 30.07.2025 there was no representation for the appellant.
4. Considering that the matter was matrimonial dispute and there was interim order in favour of the appellant, this Court by an order dated
30.07.2025 issued notice to the appellant in view of the absence of learned counsel for the appellant on the aforesaid dates to make alternative arrangement.
5. Notice was sent on 31.07.2025 to the appellant and the same has not yet returned.
6. As per the mediation report dated 07.01.2026 notices were served to both the parties but the appellant did not attend.
7. Today also there is no representation for the appellant.
