2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. Heard the learned counsel appearing on either side and perused the materials placed before this Court. Considering the nature of the order proposed to be passed, notice to respondents 4 and 5 is dispensed with. 3. On perusal of the records, it reveals that the dispute is in respect of the land in Old Survey No.152/4, New Survey in S.No.10, between the petitioner and the respondents 4 and 5.
The subject land is a private land and therefore, the writ petition is not maintainable since the dispute between the petitioner and the respondents 4 and 5 cannot be resolved in the writ jurisdiction under Article 226 of the Constitution of India. Therefore, the representation submitted by the petitioner cannot be considered and the writ petition is devoid of merits and accordingly, stands dismissed. However, the petitioner is at liberty to approach the competent civil court for appropriate relief, if so advised.
