According to the brief facts of the prosecution story, on the basis of the statements recorded during the Marg inquiry and the post-mortem report, the deceased died by suicide by hanging on 08.01.2026 due to alleged physical and mental harassment caused by her husband, i.e., the present Applicant. It is alleged that despite having two minor children, the Applicant intended to remarry another woman and subjected the deceased to physical and mental harassment. It is further alleged that on the date of incident, during an altercation, the Applicant slapped the deceased twice. Based on the aforesaid allegations, the police registered the offence as mentioned above against the present Applicant. Hence, this application. 3. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. He further submits that there is a delay of about two months in lodging the FIR by the father of the deceased, the Applicant is in custody since 20.03.2026 and the trial is likely to take considerable time for its conclusion, therefore, it is prayed that he may be enlarged on regular bail. 4. On the other hand, learned State Counsel opposes the bail 3 application and submits that the Applicant, who is the husband of the deceased, had left the deceased along with their two children at her parental house. She further submits that the marriage between the Applicant and the deceased was solemnized in the year 2021 and out of their wedlock, two children were born. It is submitted that due to the alleged extra-marital affair of the Applicant and the mental harassment caused by him, the deceased committed suicide. She further submits that though there is a delay of about two months in lodging the FIR by the father of the deceased, the allegations prima facie disclose abetment to the commission of suicide by the Applicant, therefore, it is prayed that the bail application may be rejected. 5. Considering the submissions advanced by learned Counsel for the parties, the nature of allegations, the fact that the deceased was the wife of the Applicant and had allegedly committed suicide due to physical and mental harassment caused by the Applicant, the allegations regarding the Applicant leaving the deceased along with her two minor children at her parental house, the allegations of abetment to commission of suicide and without expressing any opinion on the merits of the case, this Court is not inclined to grant regular bail to the present Applicant. 4 6. Accordingly, the bail application of the applicant – Dayal Ratnakar involved in Crime No.51/2026 registered at Police Station – Banki Mongra, District- Korba (C.G.), for the offence under Section 108 of BNS is hereby rejected. 7.
